under this scenario your 5 years will be started from 2010 thats the time when your eea partner registered under WRS scheme. Because under old rules all A8 nationals need to complete their initial 12 months under this scheme in order to be freed and access the labour market and benefits.

WRS scheme existed between 2004-2011 for A8 nationals. 5 years period will start from the time when eea national start to excercise treaty rights and the time under WRS will be included in those 5 years for getting PR. However, eea national should not be away from country more than 6 months in a year.

Refer to ukba website, there is a large chapter regarding public benefits and their affects. According to it certain benefits are allowed and does not cause any major negative results such as income contribution related ones but certainly not the ones like housing and job seeker

Best is to request your SAR file from UKBA to know what information they held for you and also keep in mind that your EEA family member must have been excercised its treaty rights for all of the duration you hold eea family permit.

@cs95tg every in time application get section 3c protection till the date of decision even till appeal result. And 10 days are the days for which caseworker use discretion under 10 years for 1 time. During 2009-2010 many tier4 people refused but get same standard letter either to appeal or fresh app...

EEA family permit route will certainly not be relevant for you perhaps the most fit category will be British partner dependant and for which you will have to undergo the new rules introduced in july 2012.
