ILR and recourse to public funds

Hi, My wife is currently on a spouse visa which expires on 2 June 2011. We are looking to apply for her ILR with form SET(M). She is a citizen of the United States of America. I am a dual national of the UK and France. The spouse visa is a 2-year probationary period with NO RECOURSE TO PUBLIC FUNDS ...

Hi Trent, That's very useful info, thanks I still have a lingering doubt though. It talks about my right to bring my wife into the UK and my right to choose which route to take (EEA or UK immigration). The problem that I can foresee is that I already did bring my wife into the UK 2 years ago and I c...

first of all, you need to check the UKBA's website.
http://www.ukba.homeoffice.gov.uk/eucit ... sibilites/

If you still have questions after reading all you can on there, by all means ask specific questions on this forum.

the residential requirements are straight forward: In order to demonstrate the residential requirements for naturalisation you need to: -have been resident in the United Kingdom for at least three years (this is known as the residential qualifying period); and -have been present in the United Kingdo...

Hi Stefan, My thinking was that if I can still get her to apply on EEA2 based on her marriage to me the Frenchman (rather than to the Brit), it will give her 5 years and it costs us nothing, and she can keep working if she wants to and if she wants to stay at home with the baby, she can do that too....

EEA2 route instead ?

Thanks for the answers. I have just found out that there may be another route. I am a dual national British/French. Is it still possible to apply with form EEA2 for my wife to obtain a 5-year residence permit based on her marriage to me the French citizen ? I realise that this is the route I should ...

EEA2 applic. for US wife (dual national sponsor)

Hi all, I wonder if anyone can help me with this problem. I am a dual French/British citizen. My wife is from the USA and she is on a spouse visa which has a 2-year probationary period (ends 2 June 2011). Her next move could be to apply for ILR based on her marriage to me (the British citizen) but t...

It is my understanding that a US citizen has to enter the USA on a US passport. However, in practice, the immigration officer will rely on the place of birth to make that call. If your daughter was not born in the US which is what I infer from your post, then her place of birth will be somewhere in ...

It looks like you husband will not be able to provide any of the usual evidence of good character such as P60s, etc.... That does not mean that his is not of good character but since the burden of proof is on the applicant, it could be a problem. However, there may be other issues here. You sau you ...

Looking at the UKBA's page on family members of EEA nationals, it seems that a residency card (obtained using form EEA2) is not such that you would be free from immigration controls as there is a 5-year validity period. For you to be naturalised on the basis of marriage to an EEA national, you would...

Naturalisation application- free from immigration control ??

Hi, My wife is from the USA and she has been in the UK for about 4 years. The visa she is on now is the so-called spouse visa which has a 2-year probationary period which ends in June 2011. We could apply for indefinite leave to remain for her. She meets all the criteria. It costs £900. I checked t...
