Please elaborate. Come back every three months for how long? Is this your existing employer or would you be making another application for sponsorship? Would your salary come from the UK company of from the overseas subsidiary? Thanks for your message Lucapooka. This is an opportunity with a new em...

UK Based overseas job

Hi, I'm sure it's been asked, discussed and answered several times before but as you all know the rules keep changing. I have been working here with a WP for 3 years and now there is an overseas opportunity. The company is UK based and I can negotiate with the company to come back to UK every 3 mont...

I really don't know and can't figure out an answer to your question but I wish you good luck. Hopefully it will work out well! But I also find that "employer has to declare that they still need the migrant" rule is very silly and makes no sense. I mean the employer made an offer to you bec...

I have just compared the current rules there seems to be only one difference between them. Paragraph (b) of Tier2 and Paragraph (ii) of WP Requirements for T2 ILR (a) The applicant must not have one or more unspent convictions within the meaning of the Rehabilitation of Offenders Act 1974. (b) The a...

One thing to check is that your new job is NQF6 or above (which you can check in SOC) because that will be a requirement for T2G from 14 June. Your new employer is likely to have to carry out a RLMT and only if that is successful can they assign a CoS to you. Any job offer would be subject to that....

WP holder changing sponsor / job

Hi, I am a work permit holder an entered the UK late 2008. And when I entered my job was in the "shortage list". Unfortunately it's not anymore. At the moment it's quite likely that I will change my job/employer. And I would really appreciate if someone help me by explaining two things: 1....

There are two types of AA visas. 1) TR businessperson - you need to be in this category for 4 years to be eligible to apply for ILR 2) TR worker - you do not qualify to ILR under this visa category. But what you can do is go through "10 years legal" route if you stay on this visa for 10 ye...

Just two questions;

- is it a final statement? Do you think they can change their minds again? (I@m becomin paranoiac I guess)

- Am I correct in saying: if I change my visa from WP to T2 I DON'T need to meet the £35K requirement.

If that's your only point, then you don't have one! The UKBA makes the rules and makes it clear they are subject to change at any time: http://www.ukba.homeoffice.gov.uk/visas-immigration/settlement/ "The Immigration Rules are subject to change, and you must meet all the requirements of the ru...

But here the document clearly says that any one came in pbs after apr 2011 so we don't need to be worry about it if we applied before apr 2011. Agree? Agreed sheraz_aries. Fingers crossed the changes will be reasonable... I should stop speculating coz it's making me more worried. :) We'll see in co...

But you can see that they also mentioned that the changes would effect migracts entering point bas system from or on 6 april 2011. what your thoughts on this? That's what they initially said but now I feel like it'll apply to anyone regardless of when or how they entered any route to settlement...W...

Well, I guess they do have the right to limit immigration, or even to stop it completely - if they think it is going to be better for the country. What they do not have a right to do is to let people in on certain conditions, and then later on change the conditions. For example, what are the condit...

Has anyone got any infromation on what's going to happen to those on Work Permit but switching to Tier 2 yet?

All I got so far is generic responses, repeating the 'uncerainities' in the consultation paper.

If they're not willing to give you the original, just kindly ask them the copy as 'true copy of original' or whatever the legal wording is...

I am not sure if you'll need it but, just in case get a copy.

Well...to me they should count all, coz they're both some ways of contributing to business, either as an employer or employee. I don't understand why we can't "mix'n match". But on the other hand these are the rules. So if you are made redundant, try to find a new company who can sponsor y...

I'm sorry mate, I don't think you will be able to apply for ILR this year. Turkish Worker Visa holders are not eligible to ILR. But if you have been employed for 3 years then you can work for any employer provided that you do the same job and after 4th year you can work for any one in any type of wo...

Caseworker's discretion

I have read these words in many documents but still don't know what exactly it means. Can you please tell eme what you think? - Is it a 'final' decision that can't be challenged or appealed? - Does the caseworker need to give a reason for his/her decision? I mean can he/she say 'I felt like that and...

I have read through all the above posts. I wish to raise the point for work permit holders (those with 5 years work permit visa) who are due ILR later this year. Some of them have gaps in their visa between EC and date of entry which is more than 3 months (so they cannot apply for ILR under recentl...
