To answer in brief - After 6 years of lawful and employed stay (Tier 2 - 3+3 years), they can apply for an ILR provided they are paid at the appropriate rate and get a minimum of £35,000/ year.

Please read up the guidance documents to understand more. This is a pretty basic question.

The spouse of a work permit holder is entitled to take up any lawful employment.
Except for a doctor in training position.

The dependant of a Tier 2 holder is free to work in the UK as long as the endorsement in their passport places no restriction on their employment here.

I think if it was the VFS then you do stand a chance. I am really not sure if they can refund the payment, why dont you ask them? They are pretty good with their customer service. The best thing would be to make a new application in my opinion.
