Re: PEO ILR Success Despite Criminal Conviction, SP30,Court

How wonderful and what a weight off your mind. Did you see what UKVI has been doing here; you have now passed to next level in the British induction and assimilation programme: graduating cum laude in basics of British stoicism; bulldog spirit (foundation level); queuing 101; Thank you, that was we...

PEO ILR Success Despite Criminal Conviction, SP30,Court Fine

For many on this forum who attain their ILR on a date, that particular day goes down in history of the new life they have built so painstakingly in this country. 21st December 2016 marked that day for us. Here’s my experience of my husband’s ILR attainment which I thought might be useful for all oth...

Re: Is change of soc code allowed when filing ILR

I would think that at the time of ILR, they will consider the SOC code you were on previously when you became eligible for ILR. In this case, if your SOC code is not a the 35000 exemption code, then I doubt you will be considered. You probably need to change the SOC code before you attempt ILR.

If they were born in the UK then they do not need to apply for ILR. Re: Job Interviews getting difficult

Hi, The industry is getting competitive and recruiters and companies want to ensure they get the right candidates. There is a cost involved to the company, agency, time spent, recruiting a candidate. If they have taken the pains to bring you in for a face to face, it is highly unlikely they would d...

Yes, that should suffice.
Are you sure you do not have your air travel tickets. These days they are generally emailed.
Also, you have the option of getting a Subject Access Report.

Re: About Tier2 visa continues Period. Urgent, Please Help!

With your new Tier 2 sponsorship which you expect to get around sept 2016, you should qualitfy sometime in 2021. If the laws remain the same as they are now, you should be eligible for it at the end of your 5 years' time with the second sponsorship.

Re: Is the Tier 2 Applicant exempted from 35K rule?

Hi thanks for replay again. I spoke with ukvi helpline and much relieved for my brother. The rep said that he is exempted from 35k criteria as per tier 2 policy guidance 10:265 since part of his leave is from the cos issued before 2011 rule. I asked about cos but ahe said that becomes irrelavant as...

Re: Is the Tier 2 Applicant exempted from 35K rule?

Seems it all depends on the current COS. If it was given post 2011 (which it is in your brother's case), then he won't be exempt. See here: http://screencast.com/t/Wky8TABiFzwD This might be of importance: Shortage Occupations If the migrant is currently sponsored in a shortage occupation role they...

Re: Is the Tier 2 Applicant exempted from 35K rule?

Hi - Apologies if this was taken the wrong way but I was not implying that the salary be increased for the sake of the ILR. I was just wanting to understand if this new requirement essentially means that once you have been granted an ILR, you must be held to that threshold as long as you live in th...

Re: Is the Tier 2 Applicant exempted from 35K rule?

http://screencast.com/t/p7rK4Xvlb7an You're partly right. As someone who was on Tier 2 Gen before 2011, he is not under restriction of the 6 years maximum Tier 2 Period. What he will however need to demonstrate is the 35K salary. PS: Having read this, http://researchbriefings.parliament.uk/ResearchB...

Re: Is the Tier 2 Applicant exempted from 35K rule?

Dear Members, My brother has booked his ILR Set O appointment on 25th Aug. He entered as Tier 2 General migrant on Dec 2009 and has since been on Tier 2. He applied for ILR in Dec 2015 but was refused as his sponsor licence was suspended and later revoked. He was served with 60 days curtailment. Wi...

Yes, he will be subjected to the 35K salary rule unless he has a Ph.D or is employed which is a Ph.D based role.

Re: 28 Days before ILR rule

You should be fine.

As long as you are counting your anniversary date from date of arrival you will be ok. Try not to book your appointment exactly 28 days back, maybe relax it a bit to 25 days just so case worker finds it easy and simple.

Re: 28 Days before ILR rule

ILR application is based on the 5th anniversary minus 28 days of your ILR eligibiliy stamping. In your case it is 15-12-2010. However you made a late entry into the UK, which was 11-08-2011. With that date in mind Vinny has given you your eligibility date as Thursday, 14 July 2016. Fine until now. H...
