To be honest,i think you should wait until you get the visa refusal letter (if it has been refused) It is possible they can word different. i think you need to investigate more about your changing your husbands visa to a spouse visa. with what you have said so far I am not convinced that he cant be on a spouse visa. You will be fine,just stay positive.The main thing is you get across to the judge the reason you cant go home.If you have family and kids here then that will be the reason you use.With the new rule of the Children's Act 2009,you can explain the inpact it will have on your children (if you have any)....

I have to agree,oral hearings have a much better outcome! Your wife should really attend as this could look bad as to why she wouldnt attend the hearing of her husband.Its only a day she would need to put aside and if you are not in the country its good for them to see you have supportiv family here...
