Indian law requires that she surrender her passport. Taking out an OCI is optional. If she doesn't surrender it she would be liable for a fine if and when she tries to travel to India

You need to surrender your passports through VFS. There is a grace period of 3 months within which you can still use the passport.

He must claim equal or more number of points as compared to his last grant of leave in the qualifying category (which is 22-Feb-10 as per your post - so he must score 90 or more points). As far as I am aware there is no need to match the points gained in your previous application as long as the thr...

Thanks Linkers,

We will be applying under Tier 1 General so will be using the Set O form. Just wanted to check if this is the same form the confirmation page refers to or if there is any other form in addition.

To do so it asks us to click continue / next. However on selecting next there is no form shown or any option to download one. Coul...

Found the following a bit confusing though: Tier 2 is intended to provide a solution to temporary skills gaps in the domestic labour market. So in future, temporary leave as a skilled worker will be limited to a maximum stay of six years and Tier 2 migrants who leave the UK will need to wait 12 mon...

Wait for a formal announcement by the ukba. The sun is not a reliable source of information for future changes to the immigration rules. I agree with Greenie on this. There is still nothing on the UKBA site to this effect and it is odd that no other mainstream paper or site seems to have anything t...

Even if she has her own bank account you should be able to use her statements as they would be coming to the same address. i believe a lot of people are worried about this. People should read the MAC suggestion and the ministerial statement. It clearly says it will apply for only those people who came on or after april 2011 Below are the document you should read http://www.ukba.homeoffice.gov.uk/sitecontent/documents/n...

Hi All, I was unable to make out for sure if this applied to all routes or to specific routes. I see that on page 30, point 3.12 it states "The family migration route does not include dependants of migrants in other routes (for example, Tier 2)" But then again if they are talking about the...

Well they also state that any application for residency will be judged based on the rules in place at the time that the application is made.

I am hoping that they will make transitionary arrangements for people like us if they decide to extend the eligibility period.

Agree mulderpf, While the consultation speaks specifically of being applicable to people entering these routes post Apr 2011, the UKBA page does not clearly state this. Most people have stated that this is implied, but id be very cautious till they said something clearly. Is there some sort time fra...

They hardly say anything directly in the mac report!!! confusion still persists for tier 1 visa holders, atleast for those who have to aplly for ILR in 2016. Bash, the report states quite clearly that the the consultation deals only with people who entered Tier 1 and 2 in April 2011 and would be app...

prda,

The update states that the same rules will apply. So you will need to obtain 75 / 80 points depending on the date of your original application. As long as you make the points, the exact amount of your salary will not matter.
