Once again I will say that we need to take a step back and look at the big picture. There is no point in reacting to statements made by a politician, or an article in the media that is propogated by a think tank. What matters is what the government says. And at no point have they said that there is ...

ukswus, Please read the original draft, the text states that they want to restrict access to tourists and visitors , nowhere does it say immigrants. The NHS has an outstanding amount of over 40 million from people that are not eligible for this service. If they had paid up it would result in better ...

The change they are asking for is to remove access for temporary visitors. Anyone here who is working legally and is paying NI will still have access to the services. Before cribbing about the NHS you should remember that it is still a service that works, albeit slowly. I am from India and anyone el...

Whatever rights you have to work in the UK on your vis will continue till a decision is reache on your application. You will need to submit a copy of your previous visa along with the certificate of application that would have been issued by the UKBA. Your employer will then have to fill out a form ...

I would use the entry date as the date of travel where the trip was short haul, like to Europe for example. And the previous day if the trip was long haul, like to Australia for example. From what you say you are way below the threshold so it shouldn't be a problem. If you read the guidance on absen...

Hi Black_bird, You can ignore the dates you left the UK and the dates you entered the UK. The calculation that you have mentioned is all right. The only thing to check is if the entry stamp from Morocco is for the same day that you left the UK. For example if you took a night flight from the UK on t...

Mealos, There is no specific instruction for application of the 28 day rule for dependants anywhere on the UKBA site or in the caseworker guidance. In my case the CW refused to apply it and stated that it is applicable only to the main applicant. I applied 2 weeks prior to completing the 2 years. Bu...

Hi Arihan,

She does not need to change her visa. As per the current rules she can continue on her Tier 2 dependent visa, even though you have attained ILR, and apply directly for ILR when she completes the probation period.

The requirement is that if you submit your application 28 days before the 4 / 5 year anniversary of your stay in the UK you should have completed 4 / 5 years and 11 months depending on the whether you had HSMP or Tier 1. If you entered the UK on the 15th June and complete 4 years on the 15th June 20...

Obtaining ILR does not have any effect on your Indian citizenship as it is only a type of visa that gives you the right to stay in the UK indefinitely. It does not give you any form of citizenship in the UK and therefore you remain an Indian national. You will need to surrender your passport within ...

Your 5 year period can be taken from the day your visa is valid from, if you entered the UK less than 90 days after the visa was issued. Is the valid from date on the initial visa 15/6/09 or is it earlier and you entered the UK a few days later

Your period of 5 years can be counted from the date the visa was issued if you entered the UK within 90 days from that date. So you are well within 5 years if you count from the 28/01/2009. Also you can apply for your ILR up to 28 days before the 5 year anniversary. So even if you calculate from 08/...

Hi xyz, UKBA will consider a 12 month period that falls within 15 months of you applying. So if you are applying on 01 June 2013, you can take any 12 month period from 01 March 2012 onwards. If you were employed for the period March to June 2012, it might be simpler to show that as a continuous stre...
