nmm, the confusion is because of the "before their current leave expires" bit. Some people's current leave doesn't expire before completing 5 years (such as in this case) so they think this rule doesn't apply to them.

Solihull PEO. Is there a limit of 225 absences?

Hi IB,

I've read in a couple of threads now that PEO in Solihull won't consider your application if you have more than 225 days of absence whatever evidence you have. Is it true? I have 252 days and an appointment in Solihull.. :(

Thanks.

dependant's visa status if main applicant gets an ILR

Hi IB, I plan to apply for an ILR later this month. I have a son born here who is now on a dependant Tier 1 visa. I would like to use MN1 to get him British passport bypassing ILR to save money. The question is if we get an ILR what happens to his current dependant visa? Will he be able to travel on...

Hi tier_2_applicant, there are contradicting messages on this forum. The guidance clearly states that you can only apply if you do not have enough leave remaining. However there are numerous examples where people benefited from this rule even though their visas were not expiring. Me personally - I w...

Arj12345 : I myself had enough leave to cover 5 years from date of entry but I still benefited from this rule. I also asked the case worker about this and he said that anyone can benefit from this rule. I personally know a lot of people who applied 28 days before the 5th anniversary of their EC (ev...

They only discount it if the applicant's visa expires earlier than 4years 11 months from the date of first entry . Which is not the case here. Correct me if I am wrong.. Where do get that from? There is no such thing as 4 yrs 11 month. 5 years means five full years. No other way to look at it to su...

If you got your EC done on 10th March 2008 then you will be eligible for ILR by 12th Feb 2013. As the case workers discount the actual date of entry as long as it is within 90 days from the date of visa being issued. Thanks! They only discount it if the applicant's visa expires earlier than 4years ...
