One more question - an I right to assume that they will not take the decision on the same day(PEO) as I have more than 180 days? So PEO service is worthless for me then, isn't it?

yes, my current leave is valid until I have stayed here 5 years exactly. I think UKBA gave it to me on purpose so that I didn't have to apply one more time. But they issued it 3 and a half years ago when the 3 month rule didn't exist yet. So if they were not so generous with me - I would be able to ...

ILR false start

Hello, I have a small chance that I can apply for ILR a little bit earlier by using the new 3 months rule (using the EC date rather than first entry). However as this depends on the case worker I am afraid my application could be refused. What would be the downsides of this potential refusal? Should...

ILR absences (Tier 1)

Hello, I have 256 days of absences from the UK. I work from home for a multinational company so I can work from anywhere in the world where there is Internet access. For this reason I sometimes work from overseas and my employer is not aware of that. Now I need to apply for ILR and what I can get fr...

Q5 says "My current leave as economic migrant expires before I complete the qualifying residential period. Can I apply for ILR?" My current leave does not expire before I complete the qualifying residential period. So the answer shouldn't apply to me should it? My current leave covers the ...

Calculating 5 years (Tier 1 General)

Hi, In some cases, applicants may have been granted five years continuous leave, but due to delayed travel will not have spent five years continuously in the UK before their current leave expires. I was unlucky (it is funny but at the time I thought I was actually lucky) and HO issued my Tier 1 visa...

Hi sushdmehta, I just called BRP team and they said it doesn't make sense to take biometrics from a newborn, as newnorns can't do much - there must be a mistake in UKBA.

I will call UKBA tomorrow to clarify.

It is funny because I believe taking biometrics from newborns is just wrong.

biometrics for newborn

Hi, I have applied for a dependant visa for my newborn baby. I don't have BRP as they didn't issue them at the time. However I have to book an appointment now for my son. This post is just FYI. I find it very funny - we will not have our biometrics stored in HO database but our 2 month old son will....

Thanks, mvent00, Just to confirm I am doing everything correctly now - I am here on Tier 1 General. My wife is on Tier 1 General dependant. We both are here since 2007. We have a baby boy born in April 2011 here in London. The only complication to our case is change of spelling of our last name. So ...

Tier 1 dependant application

Hi, I am now submitting an application for a Tier 1 dependapnt visa for my newborn child (born in UK). My question is do I need to send my own passport with the application? They never asked for passport number in the application form. And I am worried they will loose it somewhere on the way. Thanks!

Tier 1 dependent - PEO

Hi all, I'm trying to book an appointment in PEO Croydon for a tier 1 dependent visa for my newborn son. A few questions - 1) What type should I select? I would expect PBS T1, but it's not on the list. Should I pick PBS T2 instead? 2) Should I enter my details on baby's details? 3) Can I come and su...

Tourist visa for a newborn (instead of Tier 1 dependent)

Hi,

I am here on Tier 1 General visa. I have a newborn baby here (1 month old). Am I obliged to get him a Tier 1 dependent or can I just get him a tourist visa until I get my ILR and he gets his British passport (registration of minors)?

Thanks!

Yes You got it bro. Also please correct the date of your TIER 1 should be 10/02/10 till 09/01/13 as per my opinion. Please cfm if I am wrong. Since your hsmp was till 24/ 10 /09, how come your Tier 1 was dated from 10/ 02 /09. That confused me. Please clear my confusion. My tier 1 is valid from 10/...

Thanks, sushdmehta.

I just expected to see other people's experiences with this new rule. But it's probably far to early to observe. Not that many people tried yet..

hsmp from 24/10/07 to 24/10/09

entered UK 09/01/08 (police stamp 15/01/08 )

tier 1 general from 10/02/09 to 09/01/13

Can I apply before 12/12/12 ?

PS: I think the ILR rules will be changed again by that time anyway, but it would be good to know.

yes, but I did get my initial entry clearance (HSMP visa) 3 months before I actually entered UK and registered with the police.. Does it mean I can now apply 3 months earlier?

Thanks!

5 years - 3 month (instead of 5 years - 28 days)?

In some cases, applicants may have been granted 5 years continuous leave, but will not have spent 5 years continuously in the UK before their current leave expires. Caseworkers may count the period between entry clearance being granted and the date the applicant entered the UK towards the 5 years, ...
