On which date was your visa set to expire in 2009? Did you stay in the UK illegally between 12 Aug and 22 Aug? If your visa had expired before 22 Aug 2009, was there anything written in the rejection letter from the caseworker giving you a delay to reapply or a delay to leave UK?

Unfortunately not. By spending over 90 days out and without a pay slip to prove you were economically active in the UK, your 5 year counter for ILR has been reset. You should extend your current Limited Leave to Remain (Tier 1/Tier 2?)

Clearly, weekends out of the country are not using paid leave, as people are not paid for the weekend, but why on earth the UK cares what you do on your weekend is beyond me (so trips to Brighton are fine, but to Calais are not). As long as they received your application on time, it should be OK. I've heard of cases where the HO takes a bit longer to process the payment - search previous posts in this forum.

If the 3 months 4 days were not for business or compelling reasons, then your 5 year counter has been reset and won't be eligible for ILR until 5 years from the date you returned to the UK after the 3 months 4 days out.
Better to renew your Tier 1 and wait.

I got that we have to declare absentees our own in ILR but how UKBA will cross verify that data with their absentees information as i think they maintain no information for Exitees.
