Misleading info on when to apply for FLR(M) on gov.uk

Hi all, I have found that the gov.uk website is missing information about when someone can apply to extend his/her spouse/partner visa under the 5 year route. The guidance notes given to applicants says "We encourage you to apply 28 days before the expiry date." but this not entirely true ...

I had a very similar situation - 44 days out of the country for medical purposes (had a letter from NHS recommending I go overseas) and 217 days out of UK in total. The CW approved my ILR without asking anything about these absences and did not even ask for these documents. I did have my full 5 year...

This is true for Natwest as well - they are only able to print the last 6 months statements in branch. Anything further than 6 months ago will need to be ordered and sent by post.

Do you have an employment history letter from HMRC by any chance? This could class as a evidence from a second source.

VAF4A - clarification on question 7.22

Hello,

I am unsure what date to enter at section 7.22 if the sponsor on ILR currently in the UK:
When did he/she arrive in the UK? - Is this the date the sponsor last entered the UK after a holiday abroad? Or is this the date the sponsor received his ILR?

Thanks

Out of interest, is anyone certain that the guidance really did appear on the site on 19 July 2012 (the date it is "valid from"?) I was keeping a pretty close eye on the guidance during the early part of August and didn't recall seeing it. If you look at the pdf document properties, it wa...

May I ask what did you tick in "SECTION 3 - WHICH CATEGORY?" ?

Did you tick Section A Tier 1 (General) migrant (excluding applicants applying under the terms of the HSMP Forum Judicial Review Policy Document)
or
Section B Highly skilled migrant?

I split the reason for absences into three columns: one for annual leave, one for weekends/publics holidays and one for unpaid leave. The total for annual leave was 143 (125 personal leave + 18 business). The total f...

Could you elaborate on the above please? I thought days out of the UK included weekends and bank holidays?
Could you provide an example of the letter you used to explain your absences?

Days off in accordance with your paid annual leave and busienss days are not counted towards the 180 days limit (although a trip ? 90 days can raise queries and complicate the case). It's a request for information you can make to ukba to ask all the personal data they have on you incl. the date they recorded for your application.

It would normaly be taken from the date the HO receives your WP application. If this date is before the HSMP expiry you should be fine.

Submit a SAR to the HO to see what date they have on file for the application.

Yes. If your new employer employs you before your ILR is approved and if this new employer has not sponsored you for your work permit visa, then both you and the employer are breaking immigration rule. Your employer could be fined and you could lose your ILR.

P60 is not mandatory.

Provide payslips and bank statements showing the income from your part time job.
And also contact HMRC to ask for your tax history and income from the last 5 years:

Is it your guess or your experience? How do you know that?
Based on several posts in this forum especially one post saying the HO distributed an internal email recently advising applications with absence issues be processed as postal.
