Re: UKBA Complaint Website

I had a similar case and I raised the issue through my MP. This helped expedite the case and I got the decision on my application within five days.

Wrong decision by UKBA

Hello Friends and Moderators,

Will a wrong refusal of visa application be considered a case of maladministration?

Thanks

Hey Friends, You know what? I had a similar experience wherein I was told to leave my application only to be processed later. They did process it but the service we typically get in such cases is hardly premium. I had raised to ombudsman as complaint and UKBA was forced to refund the premium service...

Judicial review expenses

Hello Friends, I had lodged a complaint with UKBA but am not satisfied with the response of either the UKBA or the ombudsman on it and want to take for judicial review. Can you please tell me what is the maximum that I could end-up paying if I were to lose the case in judicial review. Is there a cap...

Agree with you points. However there is a time limit within which the decisions have to be made. However in course of time spent in delay, if an applicant becomes less elligible, UKBA cannot take advantage of it. How do you know that the detoriation, in this case of family-life and relationship, has...

Well I cannot directly refute the point Greenie made since I am not familliar with the kind of visa in question here. However I can say for certain that if there is a process for grant of visa and is based in documentary evidence, then it can be taken to ombudsman. Anyway there is no harm in trying ...

Hello Joejo, What does yur solicitor say about this. I have no clue about the kind of visa you are trying to get but I would say that rather than appealing straight away, speak to your ombudsman again and tell them why you think your visa should be granted rather than refused. But as I said you real...

and if you are not able to get it from the appeals tribunal for any reason, claim compensation from UKBA. If UKBA does not agree, take the matter ot ombudsman. They police UKBA. They will direct UKBA to refund as this unnecessary expanse has occured due to UKBA's mistake.

Thats why I am saying, don't give UKBA any reason to reject your visa. Submit all the docs. Get them all checked and reviewed by friends, family, solicitor etc.

They will not play any more games, as they used to, any-more. MPs are not enforcement bodies whereas Ombudsmen are. An ombudsman is like a police for government bodies. Just as you go to police if you are a victim of crime, the same way you go to ombudsman if you are victim of government bodies. And...

Thats a great news Joejo. You have got a definite date now. Just make sure that you have sent all documents in support of your visa, to the UKBA. Also remember, however much UKBA says that they will not consider documents sent after the main application, the fact is that they are oblisged to conside...

You can call the PHSO anytinme. They will be happy to talk to you.

DO CALL THEM and explain your case. If you dont they rely on what is written in your forms. You have the opportunity/right to detail your case to ombudsman through the phone. DONT miss this.

You can call up PHSO and discuss with the person who is going to deal with your case. They are very good people and will answer your queries very well. Thier SLA is 40 working days however they generally take 20 working days. Look, Since you do not get a chance to do some sort of litigation/hearing ...

Re: Immigration.

There is a very effective procedure in UK to put the govt organisation on track. They are called ombudsman. UKBA come under parliamentary and health ombudsman. They are great people. Use them. They are law enforcement bodies for govt organisations. They work under their own legislation and are not e...

Re: Dependent Spouse working limitation

If she has the visa already stamped, you will see message as follows on it. "No employment as doctor in training". She hasn't got the visa yet. Anyway does the above message mean that that she cannot be as apprentice/in training./ Can you please elaborate this. Thanks for your reply anyway.

Re: another fresh case.

Hello nnj10, File a complain and tell them that you deserve a refund. If they dont give you refund, ask your MP to refer the case to parliamentary ombudsman. Also friends, Just spread this to the people you know are applying and have been treated badly by UKBA. You can complain untill three years la...

My Hunch is; this thread will turn into Pandora's Box for UKBA. They think they can keep making mistakes and people will simply payup the price, seems no longer a case. Yes Friends, Its time we all get onto them. You have lots of ways to claim back your money if the UKBA made a mistake and made you...

Re: Freedom of Information Act

Hello friends, Can you tell me whether I can use FOI act to know how my visa application was processed ie which all department did it go to and how much time did each department take? In principle, yes! By time, are you referring to number of days or labour hours? I meant number of days. Have you u...
