Hey Guys,

Sorry my apologies, looks like the immigration solicitor was wrong, I just spoke with the HO and they advised exactly what you said above, I need to complete the 5 yrs.

Just goes to show you need to be careful what you hear.

Thanks for the quick response. My concern is that my employer has said they are worried about my employment if I don't get my ILR before the expiry date of my existing visa.

I did read that you can apply no earlier than 28 days prior to the expiry of the existing EEA visa? Is this correct?

Just to let you know how annoying their timeframes are... mine took 7+ months and I've been with my EU partner for 4 yrs living together in Australia before we moved here. Got it the other day after applying in November 2010.
