Re: ILR rejected due to tax issue

Hi folks The wisest course of action for self-employed people would be to take all tax documents in order to support their case. In addition, employed individuals can only submit 12 months’ payslips and bank statements as Gringo did on 17 Jan 2014, and ILR was approved. Cheers Ali That is a very go...

Re: ILR rejected due to tax issue

Guys, Its not complicated, you don't have to read a 5 paragraph essay to be successful with your application. Idea is : Keep it Simple and Straightforward(KISS) If "You work"....and "your work" tells about your status and the documents to take. If you take original documents, the...

Re: ILR rejected due to tax issue

Hi Vin123, Very helpful discussion. I have a question that if Someone is claiming Salary+Dividend for 12 months (Dec 2012 - Nov 2013) and Company year end is January every year. Then there is a chance that Company Accounts will not match the claimed period (Dec 2012 - Nov 2013) because claimed divi...

Re: ILR rejected due to tax issue

You might be right in saying that HO has no direct access to HMRC database , but HO already has a mandate to speak on your behalf through your application . I believe that HMRC may have dedicated lines for HO and case worker using your NI or UTR number ask few questions about your tax history . If ...

Re: ILR rejected due to tax issue

UKBA cannot access that information from HMRC records, hence you have to take the original proof with you on the day. Read the declaration part of the application form again, the question whether UKBA and HMRC computers are linked or not is irrelevant UKBA can access any info they want about the ap...

Re: ILR rejected due to tax issue

For Tier 1 General 5 year employed route, do HO still check tax records with HMRC? was wondering as if your work in a company then you already get tax deducted by employer before you get salary each month in your account HO will not and cannot check with HMRC or companies house records. Under norma...

Re: ILR rejected due to tax issue

So if a director of comapny with shareholding only take income monthly though out whole 5 years and never take dividents what this stiuation will be like? That's perfectly a possible case. For montlhy income, there will be payslips, and for payslips there will be a P60 issued at the end of year. So...

Re: ILR rejected due to tax issue

pinkpop, There is a lot of 'self-employment' misunderstanding spread in this forum as I see it. It is very simple and a universal rule in any country except monopolies - you work, you generate a revenue or income and you pay tax to the government. Whether you worked as a limited company director wit...

Re: ILR rejected due to tax issue

It is not mule difficult as fn286 thinks. "self-employed" is a category that UKBA puts extension application. Self-employed normally operates in 2 modes a) via limited company (shareholders to take dividend income) OR b) by registering themselves as self-employed and paying Class 2 NIC Onc...

Re: ILR rejected due to tax issue

UKBA considers limited company director-employed+shareholders as self employment. So any applicant who goes for an Extension or ILR MUST take the following, otherwise they stand a good chance for rejection. For company a) limited company account statements for financial years showing net profit (fro...

Re: Tier 1 ILR and Limited Company Tax

Hi Vin123, Thank you so much for your quick reply. I'm not self employed any more since I got a nice job. I started working as a sole director of my limited company between June 2011 and March 2012, and my extension was granted on the basis of earning via limited company dividends only (no PAYE at ...

Re: Tier 1 ILR and Limited Company Tax

Ok, folks, fn286, wanderer - your last chance to get this right. And it appears like someone has mis informed fn286. If you are self-employed: you MUST file a tax return. A limited company director without a shareholding in a company is NOT self-employed. However, all active company directors must f...

Re: Tier 1 ILR and Limited Company Tax

Wanderer, Please don't escape the scene - understand this for your benefit. A Limited company director is considered as self-employed and he or she is required to file a tax return. The reason being, a directors pay can 'vary' even if he or she is not a shareholder of the company or not. For people ...

@fn286 It does not matter tier 1 extn or ILR - it is the same set of documents you need to take from a income demostration perspective. Re: self-employment. I still stick to my guns, and you can ask anyone else or come on, Wanderer - prove me wrong !! Once again, I repeat - If you are a sole direct...

Re: Tier 1 ILR and Limited Company Tax

I think you underestimate the power of HMRC, and you need to study some Company Law, being a Director is not self employment. Come back to us then when you've done a little reading...... you meant UKBA :D ; right ? Check this http://www.hmrc.gov.uk/leaflets/es-fs1.pdf http://s29.postimg.org/f6wf1ti...

Re: Tier 1 ILR and Limited Company Tax

If you are sole director with 100% shareholding, that is considered as self employment. In UK, corporation tax is not that 'heavy'. Re: Expenses A company will have 'expenses' if it makes a revenue. It is not UKBA' official job to question about validity of expenses claimed and its admissibility by ...

Re: Tier 1 ILR and Limited Company Tax

Hi both No confusion. If you are self-employed as a sole director and 100% shareholder of a company, then your yearly income to show is = companies net profit + Salary you draw from company accounts(if any). You may add dividend vouchers as well, but it does not matter in the above scenario. However...
