me my wife and 2 children are on 30 months leave to remain and 1 elder child is 11 and British citizen.

Hi we have been gone through inn this situation exactly the same. We went to JR then first tier tribunal. Just be carefull make sure when you go for hearing you must sit with your barrister and discuss with him/her. I was given a letter prior 1 weekk of our hearing and we were not prepare for that. ...

Your first solicitor did wrong. When you applied in feb 2012, that time no 7 year child rule, 7 year child rules came in july 2012, that's why they refused. after refusal you go JR, in consideration they refused and given a right of appeal, you will be fine in a appeal process.
