It is worthwile getting a competent solicitor for an appeal if you can afford it or if you are eligible for legal aid - I think your partner probably is eligible for legal aid as he has a fairly low income - try TRP solicitors in Birmingham http://www.trpsolicitors.co.uk/ Thank you so much for this...

You won't be able to submit evidence that wasn't available when the decision was made. You may have a chance of the decision being overturned before it reaches appeal if an error has been made. Are you able to seek legal advice on this? I don't know if I would be able to find a lawyer here in the S...

I'm really sorry to hear of the refusal. If you have proved in the application that your husband's income meets the weekly minimum of £105.95 remaining ...taking into consideration that the ECO accepts you will be living rent-free, I would appeal the decision. Especially as there is an error in th...

Does the historical cashflow in that account have sufficient traffic to support another adult consumer added to the current outgoing expenditure that is for just one individual? I am not sure how to answer your question, but here goes: Other than that one month that the ECO stated in May there has ...

First, I want to say THANK YOU to everyone on this board, especially Casa, because I would not have been able to do it with out you. My reason for posting today is because my application was refused! Given the circumstances I...

Yes absolutely it will! That means that virtually all of his monthly income will be considered maintenance which helps a ton! I will have them change the 'do' to a 'will'. Thank you so much for all of your help! We are applying tonight and then sending the evidence off once I have arrived back home ...

That's Great! I know my in-laws will have no problem stating that they are giving us 'rent free' accommodation as they don't actually require that we pay them anything we just help out. The one problem might be that if the ECO looks carefully at my husband's coming and goings on his bank statement t...

You haven't missed anything. You are correct. He doesn't make a ton of money but he does make above the weekly minimum after rent, council tax, and loan repayments. It is not much above the weekly minimum but it is above. They are simply providing accommodation though it is not free we will be payin...

Are they providing 3rd party financial support? Would it be better to put the bank statements and payslips under Financial instead of Accommodation so that way it would show third party support? Would there have to be another form filled out or would they just need to include it in their letter of ...

Now I am confused. I do have a copy of the mortgage statement from last year showing payments and an up to date copy for this year showing they are caught up on the payments. Is that considered the mortgage agreement? I am siding with you now that I probably shouldn't includetheir financial informat...

We met with a solicitor at one point and she told us that she had previously seen an application denied due to lack of proof that the mortgage could be paid by the parents they were going to live with. So she suggested that we include that information to show proof. Is that wrong?

List of evidence documents for Spouse visa

Hi all, Below is an indexed list of the supporting documents I have collected for my spouse visa which I will be applying for in just a few days. I have opted to do two folders (one for originals to be returned and one for copies they can keep) so you will see by some of them whether or not it is th...

The minimum weekly amount of £105.95 is after rent/mortgage, council tax and loans/credit have been paid. If I am doing a monthly budget showing maintnenance for the evidence would I do 105.95 x 4 = 424 or would I do 105.95 x 52 / 12 = 459? One more question (sorry) do they look at the payslips fo...

A couple need only deduct rent or mortgage, council tax and any loan repayments to show the minimum of £105.95 weekly. Other bills and personal spending need not be included . An application won't be refused because it's not in the right type of folder.

HI, When I prepared my husbands spouse application we used a Lever Arch file. I typed up an Index at the front and used card dividers to separate each section, as per the Index. I placed everything in plastic wallets also. I suspect you are including far too much if you need two folders. I was extr...

Don't focus so closely on proving the relationship that you submit a weak application showing sufficient income and adequate accommodation (no overcrowding). Remember that you also need to submit a letter from your husband's family confirming that you can live with them. If they have a mortgage the...

Make sure you don't submit too many documents which aren't essential as you risk the ECO missing those that are. Casa, I have read several of your posts and you seem to know quite a bit about all of this immigration business. I have seen you put that on many people's posts and it makes so much sens...
