Whilst the marriage is null and void, they will need to obtain an annulment certificate from the family court, if the court grants an annulment on the basis that the first marriage is null and void ab initio, then logically the present marriage should be valid ab initio as well, that is my view only...

Is the EEA national the mother of the child? The child may not qualify for a passport if he/she is not already a British citizen, only British citizen can receive a British passport on application.

You said the appeal was successful, if it was, then home office cannot refuse, except the direction of the judge allows for that, that will rest on the wording of the determination, you need to give full details of your case going forward.

It doesn't mean your appeal has been allowed, Ftt do not usually pronounce it's decision on the day, unlike the UTT, stay calm and hope for the best.

Apologies Mred1, I thought the application was for an EEA2, which you can request back passport after submitting the application, that is not applicable to family permits,and yes authenticated copy is OK for FP applications.

I know the Gardai or INIS request passport, a copy on a phone will suffice admission, some airlines do not ask for anything at all, other than ID, passport return may take between a couple of days to 2 weeks.

She needs to send her passport, she may request it back immediately, she doesn't need her passport to travel between the countries, a snap shot of the bio data page on her phone will suffice.

Obie perhaps rosebead was meaning to say in the event the appeal should not succeed at the first tier, then applying for permission and waiting waiting time at the UTT, 1.5 year would be a reasonable prospect in that instance.

Why go and apply for another EEA-FP? He already is legally residing here regardless of the refusal, what's the point of that? If you decide to appeal, you should follow the previous link, you will be submitting a notice of appeal to the tribunal not the UKBA, a reconsideration request, you will have to send to Liverpool.
