UKBA workers acts beyond their remits sometimes and make wrongful decision, and it doesn't mean whatever they do is right in law, until their actions have been challenged in court. I believe if the holders of the BRP have made a formal request for it, UKBA will be obliged to hand it back.

Were you the applicant refused for knowing the law? Nothing needs be said about the decision, it is shameful, simple. If you are not in a hurry to return, you may well stay and sort it all out there in France, if not just come over and iron it out from here.

You will satisfy of the requirements in OB after 3 months, you do not need to be covered for 6 months, you need to be covered for the period of your stay in France.

I do not think you will be able to get anything out of it other than the apology you have received, even if there were to be, you would have spent a fortune in court fee to get any sort of compensation, it's not worth it, just focus on you receiving the FP. Good luck.

There is no burden on your wife to show that she is exercising treaty rights beyond 5 years, 5 years is what is required of her under EU law and under the EEA regulation, you have provided that evidence it was an error on their part to demand more than it is required. Good luck.
