Absolute nonsense, Your appeal is bound to succeed on the basis of the details you have provided, which region of the UK do you live? reconsideration request may be quicker than appealing as they no longer entertain reconsideration request as well as appealing at the same time.

You may well rely on Jessy St Prix case law, you will though need to show that this depression is a result of her childbirth and she was unable to seek employment because of that, if you can successfully prove that, you stand a very good chance.

Really your wife only came to the UK in 2013? Yes you have to show you wife legally resided in the UK for the 5 years period, evidence of exercising treaty right will prove legal residence.

Unfortunately it appears that your spouse may have broken residency. EEA national do not just automatically qualify for PR after 5 years of residence, they have to show that during those years they have exercised treaty rights, that's only when they automatically qualify for PR. Was she on maternity...

What did you expect when you were calling the UKBA customer services for advise on a potential application? They are not an immigration advisory services and at most clueless as to most of the the advice they offer. Go ahead with submission, you already have PR.

Appeal could take anything between 2 months and 7 months in London, if you carry on with the appeal, you will not succeed without providing a CSI and a bank statement which shows you have enough money to live on.

Don't worry about the expiry of your family permit, it would not affect your right to stay here, you will need to purchase a comprehensive sickness insurance (CSI) that covers all you and your partner, and you need to show the UKBA that you and your partner have enough funds so as to not be a burden...

Does your partner lives full time in the UK? Or he works in Milan and returns to the UK? Where is the company registered? To which country does he pay his taxes?

Sorry but the requirements are that a member must have made a minimum of 10 posts before they can access PM facilities, to encourage open posting, your 9th post may not have gone down well with the Moderating team.

You do not really need OB in my view, as you have lived in Ireland for such an extended period, you will already have engaged Reg 9, pre and post amendment, Surinder Singh and Eind will be sufficient . When do you intend to return to the UK? You may apply for a revocation, it should not take too lon...

Have you worked uninterrupted for a period of 5 years out of the 10 years you have lived in the UK? You may already have acquired PR, on your return to the UK, be sure to have evidence of your economic activity in the UK to hand, she shouldn't have any problem.

CJEU has answered those questions, the answer is negative, period of imprisonment does amount to legal residence, but that's not what you need at the moment, that is relevant to an application for PR, I wanted you to see the test, the tribunal adopted in Mr Nnamdi's case and compare it with your cas...
