Re: "Further evidence" of partnership with sponsor still subsisting?

Thanks for merging and you are right - I think it might not be a Zambrano. It's basically a late, EEA route paper application :)

"Further evidence" of partnership with sponsor still subsisting?

Hello all good people At long last my partner (EEA national) submitted a Zambrano Settled Status EU settlement scheme Paper Application Form on the basis of her relationship with me (dual UK/EEA national). After quite a while the HO responded to us asking for translation of the evidence we had provi...

Re: Late post-Brexit residence rights application - some questions

Hi, in terms of proof of relationship (in the form eg of utility bills) I have spoken to the HO over the phone and they have confirmed that they do not need these translated - the original language of issue is fine. I have a few more questions as we are getting ready to post out the application: 1. ...

Re: Late post-Brexit residence rights application - some questions

Thanks so much. Form is now apparently in the post, so it's all happening. I've two more questions: 1. Obviously much of the proof we have of living together as a couple is in Greek (eg utility bills, joint bank account statements etc). I will of course get these translated - but does the Home Offic...

Re: Late post-Brexit residence rights application - some questions

Thanks! I'm now ready (he says!) to start working on the application. And immediately - stumbling block #1:  Is this where we get the paper form from? https://eu-settled-status-enquiries.service.gov.uk/start That's where the trail of links sent me to, but all it is is a contact form through whi...

Re: Late post-Brexit residence rights application - some questions

Thanks as always, kamoe. We are at long last ready to apply for her pre-settled status as you correctly say (I am as you can see terrible with all things legal...) A final question: the people over at this forum seem to think I would need to apply using a paper form: https://www.forum.ukcen.com/reso...

Re: Late post-Brexit residence rights application - some questions

I suspect/hope this answers my first question, as indeed I exercised freedom of movement rights to move to the UK (all the way back in 2001) and retained my EEA citizenship after acquiring the UK one in 2011: A family member of a relevant EEA citizen can also apply where they are the family member o...

Re: Late post-Brexit residence rights application - some questions

Thank you for your patience and guidance throughout, Camoe and all other board members - much appreciated as always. We have now made the decision to apply for a spouse visa going via the Lounes route. However, two more questions: - As a dual (UK/GR) national myself, I never applied for settled stat...

Re: Late post-Brexit residence rights application - some questions

Thanks again kamoe and all boards friends for this invaluable info. We have been pondering out choices and have some, hopefully final, info before we decide on a course of action. Would anyone please happen to know: 1. Can my partner exit the country now and apply for the six-month EU family permit?...

Re: Late post-Brexit residence rights application - some questions

Small correction for the above: In the event you can prove that your relationship was indeed durable as early as 31st December 2020, your partner could apply for Pre-settled status directly, no need for a Family Permit, and she could do so while on a visitor visa (I think this is the only exception...

Re: Late post-Brexit residence rights application - some questions

Maybe ask them further details of exactly what they did. Did they use Surinder Singh to apply for residence in Greece, or in the UK? (The Surinder Singh route is open in any EU state). Maybe they might not have used Surinder Singh but the Lounes rote of the EU Settlement Scheme. Which, might or mig...

Re: Late post-Brexit residence rights application - some questions

In order to utilise the Surinder Singh route, you would have been required to be in an EU country of which you are not a citizen and exercising treaty rights in the EU country (of which you are not a citizen) as a British citizen, ie paying tax and having all the relevant residence etc required. I ...

Re: Late post-Brexit residence rights application - some questions

4. Since we are not married or in a civil partnership, but have been in a relationship for 2+ years, what kind of proof of this relationship would suffice? Just being in a relationship isn't enough. The relationship needs to be akin to marriage. What that means isn't always clear cut, but grosso mo...

Which EU country were you working remotely from? The one you are a national EU national of? Was your partner in the EU country with you and are they EU or no EU citizen? Thank you for your response. I was working remotely from Greece, which is indeed also the country of my EU nationality and also y...

Re: Late post-Brexit residence rights application - some questions

Can't assist with your detailed questions, however, I'm concerned by the statement "....who has just joined me here in Scotland, on a tourist visa.". Visitor visas allow only a limited range of activities, which doesn't include job seeking. I believe work visas need to be applied for from...

Late post-Brexit residence rights application - some questions

Hi all good people of the board, Here is our situation, in brief: I am a dual (EEA/UK) national having lived in the UK in excess of twenty years. I am on what is considered a good and settled salary that is in excess of what I see is required to sponsor my partner, who has just joined me here in Sco...

Re: UK-born brother in 1986 from Greek parents

It is quite possible that between 1.1.1981 and 31.12.1987, free movement of labour did not apply to Greek citizens. If that's the case there is probably one of two options: It seems like you are spot on here. a. parents moved legally with a work permit and in that case probably got ILR under normal...

Re: UK-born brother in 1986 from Greek parents

Thank you so much, JAJ, this is crucial info. Again, testifies to how invaluable this forum can be. It's not mentioned in the Home Office document (not even in the Nationality Instructions, as far as I can see) Could this be (off-chance!) that freedom of movement is perhaps applied retrospectively? ...

I think it's great that someone answers their own question. Your post may help others. If you know where your brother was born, it is possible to get a copy of his birth certificate. I hope you can find evidence of one of your parents' employment. Cheers - so, a final question: the excerpt below is...

You've found the information for yourself, good for you. Were either of your parents were exercising treaty rights (workers for example) at the time of your brother's birth? Can they prove that? Presumably your brother has a British birth certificate. (PR is permanent residence. It's not really rel...

Free from immigration restrictions = PR (under EU directives) or ILR (under UK immigration rules). Are the parents still living in the UK, i.e.- have continued to live here since? Thanks for your response! Excuse my ignorance, I am not quite sure what PR is. I just found this below; surely this wou...

UK-born brother in 1986 from Greek parents

Hello, I was wondering if anyone could help me with the following query. My younger brother was born in the UK in 1986 - two years after the law changed, I know. Both our parents are Greek. I believe that he would be able to claim citizenship if both parents were 'free from migration restrictions' a...

Just to confirm, I got PR via EEA3 with an almost 3 months long gap between jobs, on which I was mostly abroad on wedding/honeymoon "duties" :) To be on a safer side, I added on my EEA3 application a document proving I did actually looked for a job at some point in that period (a letter fr...

Many thanks once again, jambo, you saved the day. Yeah, applying for PR confirmation with EEA3 sounds very sensible indeed, and it will be their next step.

Thanks again!

Jambo, my sincere thanks! :D I have another - final - question, if you have the time. They are also concerned about the five year rule - having worked in the country for five years, one of them has a two-month gap where they were technically unemployed (though not claiming benefit). It was July-Augu...
