In these circumstances, you should seek Judicial Review. In the absence of an employer actually providing a resignition letter signed by your brother, it will be his word against your brothers, and with a backing from the employer, it will be both of their word against the ECO. Did they not give hi...

Good news…

It turns out my brother-in-laws employer didn’t go nuts on the phone. The initial questions put to him were designed to trip (when did he apply for indefinite leave , etc.) but the employer reiterated that it was a six month holiday. However the employer mentioned my bro-in-laws work application to ...

First question: my brother-in-law isn’t banned for 10 years is he? Oh yes he is. Effectively if he applied again he would be automatically refused under Para 320 7 B on the grounds that he had used deception in a previous application and this would then trigger the ban. I don't understand why they ...

It may help if his employer does confirm that he was confusing your brother-in-law with another employee. Do they have similar names and date of births, etc.? Christ-only-knows what my brother's employer was thinking when they called. I think he took the conversation completely out of context and j...

What to do?

Hi,

Hope you experts can help.

First question: my brother-in-law isn’t banned for 10 years is he?

Second question: Can we appeal, or get an Administrative Review?

Thanks,
Matthew

However the fact they spent the first 6 months of the year here wasnt mentioned in the decision. Really, so what's this? It is acknowledged that you have travelled to the UK on two occasions to visit your family – you stayed for 4 months in 2009-10 and you recently travelled from 12 Jan 2011 to 1...

Why not re-apply now for a 6 month visa? Because they have already spent the first six months of this year in the UK. They can, or course, try but it would likely be refused. Did you not read any of the comments written above? Yes I did read your comments, and thank you for your help. However the f...

Okay, but in that case you've dug quite a big hole for yourself! You've come right out and confirmed you intend to stay much longer than the periods permitted by this type of visa. Really, you should forget appealing and simply re-apply at about the same time that an appeal decision would be uphold...

Where is it best to appeal? If we sent our appeal to the Philippines would it get processed faster?

Re: 2 year family Visa refused, please help

You are now seeking a visit of between 1 and 2 years. I'm confused by this comment as, even with a long-term visit visa of 2, 5 or 10 years, the traveller is still only permitted to remain for 6 months out of 12. Its because on our original application we stated our dates of travel were "12 Se...

The intention prior to/at the time of the refusal decision was to stay longer than six months. Therefore, the refusal was correct. I believe that the appeal determination would just confirm the correctness of the refusal. Its a simple error on our part. They wont reconsider? If we binned the appeal...

If we change the dates to 6 months, and state this on our appeal, will they be satisfied?

The letter says we have the right to appeal. It also says "...it may be possible to resolve the points at issue without an appeal hearing". We are going to appeal, and I guess we need to address each single issue in the refusal within the Grounds Of Appeal section (on form IAFT-2). In the ...
