Hi, thanks :) YES, indeed, it was weeks and weeks of non-stop reading and copying of papers for the bundles, no free weekends.

Hello, Believe it or not, we eventually got there! Appeal was won, and big thanks to Obie for suggesting to use the Islamic marriage certificate as evidence of durability of the relationship! Our scary Immigration Advisor was convinced by that and changed the grounds of appeal away from trying a doo...

I feel in no position to make a recommendation, but I can tell you from experience that against what seemed to be common knowledge of really everyone and those with some expertise of immigration, the register accepted (and it was also checked within the office) the algerian national id card and driv...

thanks. unfortunately, it does not seem to go this way round, rather one has to have a civil wedding first, and then also can have that kind of religious wedding.

i cannot find information on this: today I sent the documentation for the hearing to the hearing centre, was that right, or should it have been sent to the first-tier tribunal in leicester? the instructions on the notice of hearing were not clearly straightforward, they say to 'above' address, while...

We want to do that, but the home office already has his passport since April, since the time of the application. Therefore, this is not something that we can do before the appeal at court. We have an appointment to give notice a few days after the appeal is scheduled, which was the earliest possible...

The suggestion to take the islamic marriage as evidence for durability seems a good point,. I'd greatly appreciate any further suggestions for evidence or argument.

Thanks for that document. Is that all, what they mean by merits: children, joint finances, and 2 years cohabitation? Or is there anything else they may consider? If we go the bank and open an account together, would that still help? I really did not know whether to appeal or not, I was very worried ...

Definition of 'Partner' under EEA Regulations 8(5)?

Urgent advise needed.......! We received a refusal letter for a visa application for family member of an EEA national. The refusal letter says: "we will not normally accept that there is a durable relationship where these criteria are not met, though each case is considered on its merits. There...

phew, good at least that! I hope this may be my last two questions: 1., would it be possible to appeal to this and during that time submit another application, i.e. then with a civil ceremony certificate? 2., worst-case scenario thinking: what happens if an appeal is rejected at court? or does one a...

many thanks. you have opened up a completely new line of action, two questions: is it possible to apply for the fiancee visa, as you suggested, from within the UK? and, is it really necessary to go through that step first, or also to just marry in a civil ceremony and submit a EEA marriage visa appl...

I am wondering whether this will not be a problem for my partner, i.e. will UKBA not take some action, since the visa is rejected?

Thanks a lot. I don't know whether the place had that kind of official status, I suppose not since it has not been accepted. We are thinking to have a UK civil wedding. But if we do not appeal now, what happens from the side of the authorities? Would they just let some time pass by and is there not ...

Appeal? EEA member Partnership visa rejected

Hello, Can someone give me advise, please??? I am a EEA citizen and applied for a EEA family member/ civil partnership visa (partner is in UK). The application was rejected, with the option to make an appeal - my question is: do we need to make this appeal? Or, could we also do nothing about this an...
