Re: Switch from Tier 1 post-study work to spouse visa

Hi there, I am so confused reading those guides on UKBA, hope that you guys can help. Basically I am currently on Tier 1Post-study work visa. I am now married to a French guy, who's been working in the UK since the past 2 years, and my tier 1 visa will be expired in March. Now, if I need to switch ...

You are not subject to conditions once PR is achieved. You can only lose it by being away for more than two years.

Re: Travel with Residence Card - Success Stories

I believe it is essentially not allowed because a stamp could be construed to mean leave to enter or perhaps imposing conditions.

If the OP takes the trouble to read the links, then it will be clear to her that she has nothing to fear. The Schengen states do not require entry visas of non-visa national EU family members.

A certificate application would be issued to the applicant. It will state that the holder can work. It is to be issued immediately.

Your husband would be entitled to work. The simplest thing to do is apply for a residence card.

If you have worked legally for five years, you have permanent residence as fact. The certificate would merely confirm that.

Re: EEA permit with no valid visa

You will note that the EEA family permit form does indeed ask for a lot of information that ought not to be required to make a decision. There are many different types of applicant, some of whom do require to demonstrate financial dependency. For spouses of EU workers, it's pretty simple - evidence ...

Re: EEA Family permit: EEA National with British Citizenship

Jambo, thank you very much for suggestion and clarification on CoE. I have checked some other forum threads on this, and found some very interesting posts related to Indian parents in a very similar situation as ours. As I understand, India also doesn't allow a dual citizenship. There are some succ...

Re: EEA permit with no valid visa

It is possible to apply for a family permit outside country of residence. The applicant would be required to give biometric data. Given that the US and UK share data, it is likely that visa irregularities would come to the attention of the US authorities. I have no information on what that might mea...

There are specific time periods set out in directive 2004/38/ec. Generally up to six months per year or one absence of up to twelve months for specific reasons.

I would write a letter of complaint. There is a complaints procedure available. Ask why you were detained and inconvenienced. Hopefully, the response will shed some light on the situation.

Re: EEA Family permit: EEA National with British Citizenship

I would think the child is also Italian and British from birth (if born in the UK within the last year or born anywhere after the father obtained BC). Not holding a passport doesn't mean he is not a citizen. If your country doesn't allow dual nationality, he could keep his other nationalities if he...

No visa required if travelling together. When you've returned from your trip, post your success here.

Hi, thanks for your replies! We have absolutely no worries about living/working in Spain. We both have 3 1/2 years of TESOL/TEFL experience behind us, degrees & my husband also has an outstanding resume for building jobs. The main reason we are choosing Spain is because we have connections ther...

Re: Refused a UK visa, will they let me into the rest of the

I don't think it would really matter but if you want to be absolutely sure, your husband could move to Spain first and you could apply for a short term Schengen visa to join your husband in Spain. This should be free of charge for you and they should get back to you within 15 days. Or he could fly ...

Re: EEA Family permit: EEA National with British Citizenship

You might want to think hard about the implications of not taking out an EU passport for your child. I'm sure you've already asked yourself this, but what are the advantages to you of selecting your nationality? Is it irreversible? Could the decision be postponed until the child is old enough to mak...

There are many people who ask questions that can be answered if they took the trouble to research elsewhere. There are many people who ask the same type of question over and over again, which is why we've got FAQs in the stickies section. At the end of the day, all questions are easy to answer if on...

Re: Refused a UK visa, will they let me into the rest of the

The UK refusal (as you stated for financial reasons) should not have any effect on your ability to enter Schengen zone (includes Spain). If you were to travel independently, you would need to be able to satisfy a border controller that you had sufficient funds (credit card), insurance, etc. If you w...
