Re: Wife with PR sponsoring Non_EEA National Application for

I've moved your topic to a more appropriate place.

I would suggest that an EEA type application would not be appropriate, though others might correct me. If you have PR, then an application could be made under the immigration rules.

Re: Applying in UK or from abroad - which one is better?

Regarding getting an endorsed copy of the EEA passport, check with the embassy and ensure that this is indeed a mandatory requirement.

Two weeks turnaround for a family permit is pretty reasonable.

Re: travel while waiting for eea family residence card

I followed the link and it would imply that an application for return of documents would have the effect of withdrawing the application. I suspect that this is a poorly designed advisory that is appended to all such questions. The request of document return should not affect this type of application...

Re: EEA Family Permits and TB Testing

Sorry for the belated reply…the system was being updated. Firstly, I have moved your post from where it was to a new thread. It is much better that one sticks to the topic of a thread rather than changing its course. Now to answer your question. A family permit is to be issued as soon as possible an...

If you are the family member of an EU citizen, you have the right to apply for a visa in any EU country (other than that country of which your family member is a national) under the terms of directive 2004/38/ec. You can as you've pointed out, enter under article 5.4 without a visa if you can demons...

The English in the post made is perfectly understandable. It's a good post, so don't worry at all about that. From what I've read, it is likely that the family permit refusal was not correct. If you presented evidence that your spouse was an employed EU national, that's pretty much it, end of argume...

Hi guys, My Non-EEA spouse received the following text message: "Message from the Home Office. Our records show you may not have leave to remain in the UK. Please contact us on 08443754636 to discuss your case." Background: 1. Spouse entered country legally through EEA Family Permit 2. Su...

Re: Spouse of French Citizen residing in the UK

I am a non EU citizen currently doing a PhD in the UK. My husband is French and commutes between France and the UK. My questions are: - Apparently I cannot apply for a long-term Schengen visa to go to France as I would need to certify that I want the transfer of my UK residence to France and I need...

I have no direct experience of Spanish visa applications, but from other forum members, it appears that bureaucracy can get in the way. A member state is entitled to ask that your marriage certificate is translated and legalised. That's all they are allowed to do. Appealing may appear to be a waste ...

Germany and Estonia

It is good to see that other member states' article 10 residence cards will be accepted in lieu of visa (no mention of article 20 cards though). Why Germany and Estonia and not the other member states? The answer may well be here http://www.bailii.org/ew/cases/EWHC/Admin/2012/3368.html (see point 10...

You need to be accompanying or joining EU family member in order to benefit from visa free travel.

Your passport should not have been stamped.

The procedure ought to be the same for each member state. Obtain a job, apply for residence certificate. Partner applies for residence card.

There is no requirement to have had a residence card or certificate in order to benefit from Singh.

It would be clear to either an ECO or an immigration officer that you had previously been refused visa. Being married to an EU national who exercises throaty rights in the UK would mean that you have a right to live together as a family unit. Apply, be clear on your circumstances, be clear on your r...

Basically, the issue can be summarised as follows; a person who arrives at the UK border and show entitlement to enter under the directive (regulations, etc, etc) will be admitted (MRAX), but those who do not have the correct documentation would be refused boarding by carriers.

Was the ECO aware of this circumstance? With whom do the children live? If you plan on marrying, your rights to documentatio...
