It won't happen. Its one of the most robust UKBA policies. A lot of rule changes brought into place rely on it existing. I think it will be around for a very long time. Though they might change qualification criteria.

Usually till 28 days of the expiry of leave/leave extended by section 3C a person is not deemed to ba an overstayer. It means two things. The application was valid. ie it was correct, the money was correct, the form was correct the photos were correct etc. The second thing was that the application was also out of time. ie it was made after limited leave had lapsed.

Spouse visa cannot be applied for from the uk after leave has expired. I think this is the reason they refused. There is no 28 day grace period because it is not a pbs application. You will have to leave the uk and apply from abroad.

There second application is out of time. There is a gap in lawful residence of 25 days. This is a small gap and will probably be overlooked due to discretion.
