It also depends on when his course is due to finish. If the course is due to finish after his visa has expired then the University cannot take your friend.

Why did they grant you appeal rights? If they claim to have refused your application because it was out of time, then they not have given you appeal rights since out of time applications do not have this.

I think my application is stuck in the near miss type situation anyone know if this still happens? I mean is there such a thing as a near miss because i have been told i tick some boxes then there is a BUT meaning i just wait cant be pushing the HO because i will just force them to say no outright....

I think you can appeal. Obviously the reason they refused your application was a mistake and they still thought you had an ongoing appeal but this was not so. The rules are on your side. Appeal and you will get the visa.
