Re: Gaps in continuous stay for 10 year ILR

Hi All I have few puzzling question which I need to get clear up my head before I’m going to apply for 10year ILR in next year. I came to UK 26 October 2003. I had few extensions and one extension was due to expired on 31/08/2006. However I couldn’t submit in time application and overstayed nearly ...

The gap in lawful stay is 9 days since you did not have leave from 31st December to 8 January. However the application was made 10 days out of time. This is within the 10 day allowance for out of time applications for which discretion can be exercised to overlook the resulting gap in lawful stay.

I think you should be fine. As you say the outcome date for your withdrawal is 28 January I would assume that this is the date they consider the application withdrawn and your section 3C leave ended. Your gap in lawful residence is quite large though, at almost a year. This might cause issues. I sug...

Re: 10 year query

Has any one applied under long residence and has at least two gaps been successful? I am asking because I have two gaps - the first one for two days and the second one for 15 days. The second gap is due to the fact that the university sent me the admission letter a week after my visa expired i.e - ...

So, if Section 3C/3D does not allow a new application to be made, then the new application submitted on 03-04-09 cannot be considered as an in-time application. The only way UKBA could have assessed his application was to treat it as an out-of-time application. And because he was under Section 3C f...

A friend came into the UK in Sept 2002 with a student visa. The limit applies to the time after the completion of the course that you are applying for. eg You have had 4 years on student visa for bachelors. You can do a one year masters as this is within the 5 year limit when you finish, but you cannot do a 2 year masters because this will take you above the...

Dear, my friend application to extend his student visa was refused on the 21 febuary 2012 because the bank statement was more than one month old with a right to appeal. he lodged the appeal on time and sent the bundle one week before the hearing date. but shortly after he realised that the bank sta...

What do you mean 'he got 322?' Refused under paragraph 322 perhaps. Your cousin should have got the CAS directly from the College, instead of through an agent. I think its best if he report the agent to the police so he does not get blamed. I assume he did not know that it was fake. If he knew, the...
