You had section 3c leave until your appeal rights were exhausted. Then you became an overstayer. You reapplied within 28 days but you were still an overstayer. You are mistaken. A commencement order for replacement of appeals with administrative review has not yet been published. No one knows when the law will be implemented so please stop being sensational and misleading people.

It's not that simple. The point is ltr if given on top of ilr cancels and supercedes ilr. I don't know why they did it but you have to get them to reverse it. don't let this slide. Get it sorted asap as it will cause you problems.

Yes you can but out of time applications must be completed perfectly as they do not attract rights of appeal. I don't think OP can vary the application succesfully. OP would not have valid leave. While you have a break in continuous residency because of the refusal, that is not the end of it. The rules allow breaks in continuous residency of up to 28 days. How long was the time period between the refusal or your first visa and when you sent your successful application? If this was longer than 28 days then it will be difficult. However, it is not impossible. If you can argue your case clearly and with evidence you might succeed.

You did nothing wrong and complied with immigration rules. You can make an application. You do not need to say anything in the application form unless they ask. Be truthful and you'll be fine.

They should be more flexible with this. One of my friends went on holiday for 2 months last year but his visa was expiring and he applied for an extension in his home country. This could be a work around.

There have been two options recommended to you:
1) Send application which does not qualify but is inside time limit
2) Send an application which qualifies but is outside time limit

I think option 2 is better. There is discretion on application of the time limit.

There is discretion on the 28 days if there are exceptional circumstances they will consider application made more than 28 days out of time.
