I believe Dependents cannot qualifiy for ilr with main applicant on 10 year rule. They will have to apply in their own capacity.

I know of quite a few people who plan on doing similar things to get ILR. Remember UKBA comes down hard on those who try to obtain visas by deception. This should not be a problem. The date of application is taken to be the day you posted the application, which in this case is within the range for which discretion is advised.

If you are applying by post the date of application is the date that it was posted on, not the date it was received. You could send it on the 30/28th and the application would still be in-time. You have given 2 expiry dates for your wife, so I am not sure which is the correct one.

ukba have updated their guidance this november. One change seems to be that the discretion period for a gap is now strictly 10 days unless exceptional circumstances. Also, more than one gap can be allowed in exceptional circumstances. Am I reading it right?
