He had discretionary leave to remain up to March 2014.

The FLR in October 2014 was denied as they said he was not the sole carer for his 1-year old son and that his son can adapt if he leaves the UK.

So basically they dismissed his right to family life with no right of appeal.

Thank you Vinny. So there doesn't appear to be a direct route to my wife gaining settlement except via appeal...such a shame really. Have you spoken to any lawyers or approached the ukba to apply for your wife at all? The ukba have withdrawn the feature on their website for the public to ask questions on immigration rules so I'm lost.
