Re: Jamaican with UK residence card

Do you have a BRP issued under the UK Immigration Rules? If so, you still need to apply for a Schengen visa, albeit as the family member of an EEA citizen. You do not need a visa if you have a Biometric Residence Card issued under the EEA Regulations, with the words "Family Member of a Union c...

Jamaican with UK residence card

I am a Jamaican and my wife is British, we want to travel to italy for a few days in November. I previously had a Schengen Visa but it has expired. I am a bit confused now as I have been hearing that I don't need a visa if I am traveling with my wife. Is this true? Are Visas issued on arrival in the...

Re: Spouse Visa refused via 2 year route, IS.96 Issue

I find this case quite strange. If you husband came under the rules in place before 09-07-2012, you got an extension in 2014, why did you not extend it further. I think they were harsh. Was he not given an appeal right? I suppose it was Naivety, we thought a few days wouldn't be a huge problem. But...

Re: Spouse Visa refused via 2 year route, IS.96 Issue

It would be quicker to apply for entry clearance than it would for an appeal. A friend suggested that he apply for Judicial Review on the basis that it is Wednesbury unreasonable that he be asked to leave the UK only to suit an application to return to the UK. Does anyone know if this could be succ...

Re: Spouse Visa refused via 2 year route, IS.96 Issue

It would be wise for your husband to have a solicitor with him. Thanks Casa. My husband had plans to go to Jamaica in April, I think perhaps we should request the passport back and once he leaves the country we will appeal the decision under Section 6 of the human rights act. I am not sure how long...

No, he does not, but I gather that we will need to obtain legal counsel on Monday.

Spouse Visa refused via 2 year route, IS.96 Issue

Please could anyone offer some advice on this matter. Thanks in Advance. Background My husband entered the UK on 8th September 2012, with entry clearance as a spouse from the 11th June 2012 until 11th September 2014. He was granted leave to remain as a spouse until 28th October 2016. As he was eligi...

URGENT NEED TO TRAVEL AFTER FLR(M) APPLICATION

Hello All, My partner has recently applied to extend his spouse visa. He was eligible to apply for ILR however he did not pass the life in the UK test. I submitted his application on the 22nd September 2014. We received news last night that his Dad passed away in Jamaica and now we will have to star...

Refused family visit visa for spouse granted settlement pend

We appealed in October, however we submitted a new application for family visit a second time in November which was refused for the same reason, they were not satisfied that he would return to Jamaica regardless of the ...

I just spoke to someone at the tribunal and they stated that If there is medical evidence they can put a request in for the case to be expidited. I advised that I have further evidence and they said to submit it.

Hi angie36, I only submitted the appeal last monday. This was received and I have a letter from them confirming receipt. They put a date for 4th January 2012 for appeal to proceed. This was two days after I submitted the appeal. I don't know if the application has been reconsidered by the Bhc in Kin...

Hi angie36. I don't know what to do anymore, they take so long to decide on settlement visas. I don't know if evidence regarding my medical state will speed things along. I will probably resort to contacting my MP. Because the fact of the matter is that he is not coming here to reside or with that i...

Withdrawing family visit visa appeal

Does anyone know how long after requesting to withdraw an appeal from the first tier tribunal in the UK can a person make a fresh application.

Many thanks

@ Lucapooka, In the original application we did not give a reason as to why we would not be living together permanently as yet. It was an oversight on my part. Also I believe another factor in them refusing the application was due to the fact that on his previous visitors visa which was granted arou...

So what you are saying is regardless of the fact that we submitted further evidence to support the application, those documents will not be taken into consideration? Can we withdraw the application for the appeal and just submit a new application at the BHC in Jamaica.

Family Visit visa for husband refused

My husband's application for a family visit visa was refused by the BHC in Jamaica. They basically stated that because he was married to a British national residing in the UK they were not satisfied that he would be returning to Jamaica after a 3 month visit. He has been to the UK before but we were...
