1. Member States shall issue a residence card to family members of a Union citizen who are not nationals of a Member State, where the planned period of residence is for more than three months. 2. The deadline for submitting the residence card application may not be less than three months from the d...

If the RC expired, then I assume the non EEA national has spent at least 5 years in the UK and obtained PR status (unless there were absences of more than 6 months a year). In that case, the simplest would be to apply for PR confirmation using EEA4. hopefully the EEA national still holds his passpo...

See similar discussion (although in that case the non EEA has been living in the UK for several years already) - non EEA national' s spouse(EEA) became British! help requird . In short, I would advise leaving it in the hypothetical stage as the practical implications are not clear. This has now gon...

eeaman01, which EU country is this? It is definitely not Germany or Poland. At least two that I know of: Czech Republic, Slovak Republic These two countries have laws at the moment which ensure that if one accepts citizenship of another country, they lose their original citizenship. (There are very...

I don't mean any offence but I don't believe what you say can be strictly true. Quoting directly from form AN, question 3.6: "Do you have any criminal convictions in the UK or any other country (including traffic offences) or any civil judgements made against you?" Maybe the version of the...

Please check further this information. Most country members have provisions to allow their citizens to naturalise themselves in other EEA member states. I know Germany has such provision in place, for example. I don't understand why you're questioning the loss of citizenship. Several EEA countries ...

Judgement in a collections civil case abroad

I've searched and read threads dealing with civil cases and their disclosure on the AN form. However, I can't see anything similar and all threads refer to UK cases. A plaintiff was owed money and filed a "contract/collections" civil case abroad (outside of the UK) in February 2006. The de...

Non-EEA spouse status after EEA loses EEA citizenship

I searched on the forums but couldn't dig out anything similar enough to this: An EEA national comes to the UK, stayes employed, marries a non-EEA citizen. The spouse enters the UK on EEA Family Permit. Then, the EEA national naturalises and on the day of the swear-in ceremony officially becomes a B...

We are aware that departure and arrival days don't count as absences. We are also aware that there is discretion. I read the caseworker guidance notes in the past and they are indeed encouraging. However, the core of my question is as stated before and still remains open: In practice, what physical/...

It does matter

That's exactly the problem. We feel we are close to the limit (maybe even over!) but are very worried because we're not sure . And we certainly don't want to lie! I am looking for facts on what actually happens / how absences are investigated by UKBA. Without that, it's impossible for us to assess o...

Residential requirement - how are absences actually verified

Hi, My wife (a non-EEA spouse) and I (EEA citizen exercising Treaty rights in the UK) are eligible for naturalization and would like to file a joint application for British citizenship. However, my wife travels a lot, so she has had numerous absences from the UK, which we never tracked. We can vague...

Does an EEA PR make me a person "settled in the UK"

I am a male EEA national (from one of the A8 states) who has been exercising treaty rights since Aug 2005 and acquired PR status automatically in Aug 2010 (got the vignette confirmation of PR using EEA3 only in Oct 2011). I have been in continuous full-time employment, and living and present in the ...

Thank you. I am still in the process of documenting her other absences and counting the days but I was really hoping we can wiggle our way out of them somehow. From what you are saying though, it seems like one cannot wiggle their way out of an absence in general? After all, the UKBA guidance lists ...

Yeah, I fully expect EEA4 to take longer. Especially since as posted here , that will be a more complex case. What really grinds my gears is that in my cover letter enclosed with form EEA3, I explicitly asked UKBA to issue my PR document in such a way that it denotes the date from which I have held ...

How can it raise doubts? If anything, it clarifies and erases doubts, in my opinion. The UKBA is very clear. You, the "applicant" are claiming a "relevant five year period" during which you "have exercised Treaty rights for as a whole". UKBA will then "consider any...

Non-EEA spouse of EEA undergoing divorce, with UK absences

I am an EEA citizen (one of the A8 states) exercising treaty rights in the UK married to a non-EEA female national (one of the West African countries) but going through divorce at the moment (the category of grounds used was 'unreasonable behaviour', in our case being that the two two of us pursuing...
