Re: Tier 2 General to ILR

Thanks for your reply! The thing is that my current salary for the hours I do is higher than required for ILR but lower as in current SOC. My understanding is that my salary should be at least equal to current SOC by the time I will apply for ILR otherwise I wont be eligible. Obviusly, my employer i...

Salary increase through individual appraisal

Hi All, My last salary increase was in May 2016, I didn't have any increase in May 2017, but my employer wants to increase my salary in May 2018 through individual assessment based on my performance. Question 1: does this need to be reported in SMS or this is considered as an annual increment? The i...

Re: Tier 2 General to ILR

Thanks, that was what I was thinking too but I had a word with a lawyer today who said that current SOC doesn't matter because HO will use my previous COS and SOC rate of the time when I extended the visa to evaluate my salary if it is higher than 35K ILR requirement. This is very confusing as it sa...

Re: Tier 2 General to ILR

To make it more clear: 1. My current salary is 37K 2. Current SOC code required 39K for my role Can I apply for ILR with my 37K salary or it has to be 39K+ for ILR? Someone told me that I can get the ILR with 37K even though the current SOC code says 39K because HO will use my last COS and assess my...

Tier 2 General to ILR

Hi All, I will really appreciate if Gurus could shed some light on this questions. Spoke with a number of people / lawyers and everyone is telling a different thing. 1. I will apply for ILR soon from Tier 2 General. Does my salary need to be the same as in the COS I used when I last got the Tier 2 e...

Re: How long should I be on the required salary before applying for settlement

Thanks, so to be on safe side I reckon my best bet would be finding out the exact incremental date for all employees and request my company to review my salary on that date. I was already advised by my management that they will increase my salary anyway based on my performance. Just wanted to get i...

Re: How long should I be on the required salary before applying for settlement

There is also one thing: Please see the below link point 15.7 Page 66 https://www.gov.uk/government/uploads/s ... 5-2017.pdf if there are any significant changes in the sponsored migrant’s circumstances, for example: - a change of salary from the level stated on the CoS, other than changes due to a...

Re: How long should I be on the required salary before applying for settlement

Well, I obviously don't know everyone's salary, but I reckon not everyone is getting the same amount, as many people are more experienced than the others, etc. Yes that's fine. That is not issue. I basically meant on the same level as you are. I still don't know when my company's yearly salary revi...

Re: How long should I be on the required salary before applying for settlement

Thanks, so in other words you suggest they do payrise now if their yearly salary review is in December and if Home Office raise salary requirements in May then I will have no choice but to wait for December 2018, skipping October 2018, and then if my employer raise my salary again then I can apply ...

Re: How long should I be on the required salary before applying for settlement

So I will qualify for ILR in October 2018, Home Office will update SOC codes in May 2018. My employer is saying they are happy to review my salary and match it to Home Office requirements, because they are happy with my performance and want to make sure they follow the requirements. But in this cas...

Re: SOC code update time

Thanks a lot!

Does anyone know if they are going to increase salary requirements next year or it will be the same? I am interested in SOC 2133, it was not updated for years but they updated it this year, I wonder if they will do it next year too or leave the same? Thanks.

Re: Notice period and Tier 2 validity

Sorry my bad!

So to confirm I will have 3 months notice period AND 60 days to get a new visa? After that 60 days my visa will be cancelled and I will be considered illegal in the UK?

Notice period and Tier 2 validity

Hi All,

A have the following question please: my current notice period is 3 months. If I give a notice to my employer (or they give me) will my Tier 2 be invalid immediately after 3 months or I will serve my 3 months notice and after that will have another 3 months to find a new job? Thanks.

A quick one about changing Tier 2 employer

Hi All,

A quick one please: my wife and child are currently my dependands (I am on Tier 2 General). If I change my employer and apply for a new Tier 2 visa do they need to apply too with me or their current visa will still be valid? Thanks.
