Hi nnj10, If you are saying that your visa will still be valid on the 5th anniversary of your entry date, then you will have to consider that date (and you won’t be able to consider the 5th anniversary of your EC). Thanks sunil.suneel. yeah it looks like I can apply 28 days before 21st May 2012 which is my 5th anniversary of entry clearance.

I am planning to book an appointment for 24th of April 2012.

She needs to keep coming back before 2 years if you want her ILR to be valid.

There is a returning resident rule but again that doesn’t apply if someone has been away for than 2 years.

Congrats. I think since the law changed last year, the case workers can consider the entry clearance date if the gap between entry clearance and entry date is less than 90 days AND if the visa is expiring before the 5th anniversary of arrival date (which was in your case). I interpret this law as: If the gap between your entry clearance and entry to UK is less than 90 days, AND if your visa expires before the 5th anniversary of your arrival date, then the case worker can use the discretion and can consider the start of 5 years from the date of entry clearance.

Hi hsmp28122006, that’s what I was wondering that my extension should only be valid till 21st of May. But somehow they issued it till 04th of Jun 2012.

I went to PEO for my extension a month before the expiry of my HSMP visa and my extension was granted on the same day which was 23rd Apr 2009.
