You may need Self Assessment if your income is above certain level, even if you are employed and paid through PAYE.

I was trying to find the pdf of latest Immigration Rules so I can download and print. However, it seems to be only available as hyperlink websites (I could find pdf for older versions prior to Nov 2015, but not the most recent one). Does anyone know where to find it?

I have had a similar question -- What if you are an employee, working for a large company and living in UK? The only way I can work in this country is to have a valid work permit. The employer is not sponsoring it for me. It really hurts now given the increased fees and a family of 3-4 dependents.

For the first 18 months of my UK stay, I did not have a job in UK (I only had oversees employment income, which is what I claimed in my extension applications). Seems like if the salary is greater than £155,300 per year, the resident market test can be avoided. Also, if you are already in UK, the annual cap is not applicable and it can be an unrestricted CoS. Not sure if this will help anyone in this tough situation, but hope it does.

My understanding is that the 80 points (or 75 points if your original was before April 2010) are different than 20 required points (10 each for English and Maintenance Funds). Maintenance funds will need to be proved again, while English requirement may already be met based on previous applications.

So, is it that they need to first terminate the existing employee, create a new position (that is filled with an existing tier 1 employee), and do a resident market test? Only if that resident market test is not successful, can they sponsor the tier 2?

It is 630 (for you, since you have been in UK for more than 12 months) + 1890 (for your wife planning to apply for the first time) = £2,520. For each additional dependent, keep adding another £1,890

Hi Jonbca,
Where do you see the requirement that "you do need to be currently employed when you apply"? I was not aware of this for Tier 1 General i.e., once you earn the required amount, whether or not you have a job, is not relevant (one of the advantages for Tier 1 G)

I believe you can fill application online and pay the fees now (if you have your approval reference number on the letter), and send the printed app + required docs in a few days after receiving the BRP.
