congrats!
did you send in an out-of-time application or did you appeal?

If it was the out-of-time application - did you do this by by the same-day premium service?

details would be really appreciated. I am still waiting to be assigned an appeal hearing date.

Appeal Process

Hi,

Can someone please explain to me what the appeal process is? I am appealing from within the UK against a Tier-2 refusal.

Thanks,

Greenie, Thanks for that info. I will try contacting them. I did read the clause that you cannot provide new evidence to claim points. But, you can provide new evidence to prove the validity of a document submitted earlier. So, I was thinking of showing evidence to prove that my CoS is valid (i.e. I...

peg1980,

What exactly did you say in your appeal? How did you frame it?

Also, did you opt for an oral hearing, or a paper appeal?

Thanks,
Sidj

Hi peg1980,

what were your grounds for an appeal?

Thanks,

Hi Rubzye, If you read Part 10 of http://www.bia.homeoffice.gov.uk/sitecontent/documents/policyandlaw/IDIs/idischapter1/section5/section5.pdf?view=Binary "10. ALTERED OR ADDITIONAL GROUNDS OF APPEAL An appellant may add to, or amend the grounds of the appeal up to the time that it is heard by t...

Dear arsenal49, If you read Part 10 of this document: http://www.bia.homeoffice.gov.uk/sitecontent/documents/policyandlaw/IDIs/idischapter1/section5/section5.pdf?view=Binary It says the following: 10. ALTERED OR ADDITIONAL GROUNDS OF APPEAL An appellant may add to, or amend the grounds of the appeal...

Greenie, Sorry, but I have a couple more questions: 1. If I make an appeal now, will I still have the option to send in a fresh application upon its refusal? This should logically follow from the link you just sent. Even after an unsuccessful appeal, I should satisfy all requirements for a Tier 2 mi...

Rubzye,

If you look at this: http://www.ukba.homeoffice.gov.uk/polic ... les/part9/

The general grounds for refusal state that you will be refused if you have overstayed only by 28 days or more. (read 7B)

Thanks very much Greenie! That was very helpful. Please correct me if I am wrong here - if I now send a new application, I will neither be under Section 3C, nor under 3D. Hence I will be allowed to send in a new application. Is that correct? Also, to be sure that I neither under 3D, nor under 3C, wi...

Thanks for the reply. I am in exactly the same position.
But, if you read this document: http://www.bia.homeoffice.gov.uk/siteco ... iew=Binary

it seems to suggest that we are not allowed to make a fresh application.

Thank you very much for your reply. When will you know about the outcome of your appeal? Are we allowed to give additional information in the appeal? Basically, my employer entered the wrong job code in the CoS, hence my application got rejected on the basis of a lower salary. But my salary is fine ...

Hi there,

Did you manage to resolve this issue? I am in the same situation and can't seem to figure out if I am allowed to submit a fresh application. If I can, will I still be considered to be on my PSW, even though it's last date has passed?

Thanks much!

Hi,

Did you manage to resolve this? Could you please let me know if you were allowed to submit a new application? Also, were you considered to be on a PSW in this new app (give that your leave to remain had expired)

Thanks!
