Extra unrestricted COS outside annual allocation

Hi Forum, Can an A-rated Tier-2 sponsor apply for an extra unrestricted COS in addition to the annual allocation quota ? If yes, is it merely down to them paying the extra fees and the extra COS will be allocated? If not, do they have to wait for the end of the current financial year to renew and re...

Hi, Please check the job code you will be using is NQF Level-6 or not. After 14th June 2012 only jobs at or above NQF Level 6 qualify for tier-2 general. Here's the link to updated codes valid from 14th of June 2012: http://www.ukba.homeoffice.gov.uk/sitecontent/documents/employersandsponsors/points...

Out of Time Tier-2 Application Approved !

After 7 long months, since I made my first unsuccessful in time application, my tier-2 general application finally got approved after I made an out-of-time application on May 04th. This was after 1 unsuccessful appeal to tier-1 tribunal, 1 unsuccessful permission to appeal to Higher Tribunal after t...

Re: Tier 2 Application Appeal

My friend had made an appeal for his Tier 2 Visa which was refused on salary grounds. The hearing date has now been confirmed in July. As per the solicitors there are 90% chance to win the appeal. If the appeal is in favour can anyone suggest how long it will take for him to get his Visa stamped fr...

I believe you are switching from Tier 1 (PSW)? If so, resetting ILR clock is irrelevant to you ... as it is yet to start clicking. Technically, it should since you made a new application while an appeal was pending. But in an organisation where the right hand doesn't know what the left is doing, it...

Out-of-time PBS applications are allowed because the immigration rules allow such applications to be assessed just as in-time applications. The downside (of out-of-time application) is that even if an such application is subsequently approved, any period of overstay in the UK resets the ILR clock. ...

When an appeal is pending, there is no application outstanding that one can request to vary (as you put it). One cannot vary an application that has already been refused ... and for which an appeal is pending. Section 3C makes a clear distinction between the decision on the application and the appe...

One can vary the application though.
You can make an application, withdraw the appeal and then vary your application by informing home office that the appeal has been withdrawn and that's what I did.

Section 3C protection ended when your request for permission to appeal in the high tribunal was refused (01-May). You say your appeal was pending ... but it seems that what was (perhaps) pending was a permission to appeal to the high tribunal - a permission you sought for some reason, even after be...

An overstayer is one who remains in UK beyond the expiry of leave issued. From what you have posted, you became an overstayer on 01-May. Remaining in UK as an overstayer for more than 28 days can affect an entry clearance application. Thanks for your response Sushdmehta. Is section 3C leave conside...

Yen has pointed out, by PM, an interesting anomaly when switching from PSW to Tier 2 (General). It appears that out-of-time PSW holders may satisfy 245HD(b)(i)(1) . However, to succeed, sufficient points are required. Out-of-time PSW holders may not be able to get sufficient points because of 78C ....

... because that is exactly what I did and it did not go well. The first option open to you will be to make an appeal (if your existing visa has expired). I have confirmed that the employer (A-Rated Sponsor) only need to confirm by ticking the option in your COS for you to score 10 points for maintenance. in fact the new application form does not have an option where you can tick that you are claiming 10 points for maintenance by switching form PSW.
