ILR - Clarification Absence Permitted - whatdotheyknow.com

Hi Guys,

I have asked a question on whatdotheyknow.com regarding the absence for ILR through Tier 1 General route....

http://www.whatdotheyknow.com/request/c ... ing-243055

It would be great if you can add annotations or request for further information from UKBA.

sorry to hear about your loss. I would make a police complaint for the lost bag. attach this with your application. so that they understand why u have less co-habitation docs. p60s are not must as i have assumed u r on tier 1. u shld be fine. just retake life in uk test!

if the entry was delayed by more than 90 days then you wont be eligible to apply regardless for the 180 rule. But it might be worth waiting for the 13th Dec to get more clarity.

As per the current rules, you will again have to show that you qualify with the points to be eligible for ILR. The points for earnings will be based on the last 12 consecutive months of the 15 previous mths. I am sure quite a few people would want to challenge this rule but the rule changes has alre...

I myself have had 6 months of absence from the uk and on one occasion it exceeded 150 days. Total absence in 5 years is 258 days. Obviously it is at the discretion of the case worker as I have violated both conditions. However, I have alL proofs of being paid in the uk and letters from company menti...

I am sure 180 days includes annual holidays. However, because you are only marginally over you should be fine. Were any of the days spent outside work related?

U are eligible now but obviously need strong justification regarding the absence abroad. Nature of the trip, why was it necessary, did you continue to be based in uk even though your salary was paid in India, also consequences for u and the company if the trip didn't happen etc

2015 is long way off....However, you should be eligible if you have lived in the UK for continuous 5 years...ie., you will need to satisfy the case worker that you haven't been away from the UK for more than 180 days in total and 90 days at a stretch.

You are eligible to apply if you get the required points for earnings as you have already said you have been continuously based in the uk for 5 years. As you entered uk within 90 days of receipt on the visa you can apply 28 days before the expiry of your tier1 visa. Hence you can apply after 18th or...

I am assuming that you are on tier 1. Hence, you should appeal against the refusal as your stay was valid even if the application was sent back. You will need proof of the application made on 27th sept and the communication between yourself and UKBA between 27th and 30th Nov.

I agree with Sushmehta. Also, if you are going for ILR it means that you were allowed to enter UK after the over stay itself so you have exercised the Concession!

For the long absence it is a must that you must show evidence that the absence was necessary for the business, you need to prove that you were paid by the business and it was necessary for the company as well as for you.
