Outcome

Thanks to all who replied to my post We finally received the outcome of the application from the UK Home Office. This was only possible after contacting out local MP. The HO contacted us a few days after our MP complained to them. If not for her help, we would still be waiting, and who knows for how...

Complaint

Thanks for everybody who replied to my post I have now submitted a new EEA2 application. However, the way that the Home Office replied my EEA4 application is totally unacceptable, asking me to leave the country, when they had enough evidence in my EEA4 application that I am living here with my partn...

Thanks. I was outside the country for 2 traineeships, first for 1 year and 9 months and another for 7 months Anyway, I am not contesting their decision. I am just disturbed by the language they used: "no further basis of stay in the UK" and "as you appear to have no alternative basis ...

EEA4 rejected, "no further basis of stay in the UK"

Dear all I applied for EEA4 as a family-member of a EEA national who is already a permanent resident in the UK, after 5 years as a student (now self-employed, and employed from January 2014). His EEA3 application was successfull. My EEA2 card expired this year and I applied for a EEA4 My EEA4 applic...

Yes, you're right. The first part of the address was deleted by accident when I copy-pasted. The correct complaints Email is

UKBACustomerComplaints@homeoffice.gsi.gov.uk

No reply from the MP yet.

Any Email contact?

Actually, I have no faith at all in the Emails sent to complaints@homeoffice.gsi.gov.uk because from my experience, they will take 2-3 months to reply and it seems that the people who reply have no access to the application file, because they only reply with generalities and copy-paste. Anyway, at l...

Re: EEA4 - What to do after waiting for than 6 months

Thanks Jambo I contacted my local MP about this. More on our experience: This morning, we called the number they gave in the CoA (08450105200) After 15 minutes waiting, a woman answered. At first she did not wanted to give me her full name, but I insisted. I explained that the application was made m...

EEA4 - What to do after waiting for than 6 months

Dear all My partner has submitted his EEA4 application more than 6 months ago (6 months and 1 week). No answer until now. He asked for his passport back a while ago (when the 5-year residence permit was still valid, so he could travel abroad and come back), so he's waiting for UKBA to decide his app...

Thanks, Plum70. My CP is a visa-national, that's the whole problem. We are not sure if he can enter Portugal (as in the visa application they explicitly ask for a UK residence permit number) and then reenter the UK (as the residence permit is now expired)

Travelling with non-EEA partner while EEA4 is processing

I am a EEA (Portuguese) national and my civil partner is a non-EEA national. He applied for a EEA4 some months ago. In the meanwhile he had to travel to his country so he asked the UKBA to return his passport, which they did. They have not asked it back. My partner is now back in the UK but his curr...

Thanks Jambo. Great help, thanks a lot! I hadn't thought of splitting the periods like this. I think it's worth trying. The first point is also interesting. I thought that once one asks for the passport back, the application was automatically cancelled. I'll post the developments here after we do th...

No plans to apply for British citizenship as now. EEA2 started in May 2008, he stayed out from July 2010 to October 2011 and then again from March 2012 until now. Seems difficult. It could be worth trying, using the "vocational training" exception, but the problem is that these application...

yeah, 2 years is too long. but in the case of absences of up to 1 year it seems that there are exceptions. "For residency within the UK to be considered continuous, there should be no longer periods that six months of UK absence in any one year. Absence compulsory military service does not howe...

Jambo, thanks. It's true. there's no legal requirement for renewing the eea2 or holding a registration certificate. I was surprised when I saw the expression "you do not need" in the UKBA webpage, but on further reading I understood what they mean. however in practice my partner will need ...

Englandd, thanks a lot, so the way to renew a EEA2 is to apply again to a EEA2, using the same application form? the main thing we concern about is: can they reject the application because I (the EU partner) am poor and unemployed? I have this concern because when I look at the application form I ca...

Another question: The EEA2 application form starts with a very intriguing paragraph: "There is no legal requirement for non-EEA or non-Swiss national direct family members of EEA or Swiss nationals who are exercising Treaty rights in the UK to obtain a residence card to confirm their right of r...

Can we renew a EEA2?

Thanks for quick reply. A doubt I have is whether the renewal of a EEA2 is essentially a new EEA2 application or if there is another mechanism? I could not find any information on the UKBA site about renewal, so I guess that my partner has to submit another EEA2 application. Am I right? Also, I took...

Update

An update. I applied again using exactly the same documents and my application was successful. But I haven't given up of the complaint. I complained online and the reply was very poor, just a copy-paste of the original letter. So I wrote a letter escalating the complaint, and the reply was another m...

Can we renew a EEA2?

Dear all. Two question about EEA-route applications. I am a EU national. My non-EU partner got a 5-year EEA2 visa, which is going to expire soon. I think an application for a EEA4 will fail because he was out of the UK for 2 years during these 5 years. What are the alternatives? Is there a possibili...

Thanks! That seems a very good idea. On my first application, I did explain what was the purpose of every document, by attaching some notes to them, but maybe I was not clear enough. Another question, is there any advantage of making a formal complain about this or would it make things even worse/sl...

Re: EEA3 Rejected: No Information on reason why..

I did provide evidence that I lived in the country for more than 6 years. I showed them the documents from the bank proving that I transferred money from my foreign account to my UK bank account. These documents have my UK address on it, so they are proof of address. I wonder if they want bank state...

Just to let you all know the update on this case. I wrote a letter asking for more information from the Liverpool people and (surprise, surprise), no reply whatsoever. I guess I really have to call them.

Obie: Thanks for the reply. I believe the residence card does not become invalid when the non-EEA family member with EEA2 is temporalily away. It only becomes invalid if the EEA person ceases to exercise EU treaty rights in the UK. However, as far as I know, the 6 month maximum absence does apply la...

I submitted the appliation in February and received their letter about 3 weeks later, so I guess it's not a rejection but a return of the application. I remember that when I applied for the EEA1, they did the same, but at that time they wrote specifically what document they wanted to see, and they d...
