just state the truth. but you have to meet the prerequiste residence requirements in order to get ILR..it also depends on how 'smart' the IO is!

any how i would not encourage you to go the Canadian route but the choice is yours...

Canada is a really diffficult place - unless you have Canadian experience otherwise you will be driving taxis or frying buggers!!

I was led to believe that they could refuse purely due to the overstay by one advisor and then the person I spoke to today contradicted this......aaarrrggghhh. Its all too confusing!! Withing 5 Years, what is the maximum time we can spend abroad, not to risk ILR? I am plannning to travel often for touristic reasons. How do they really understand how long you have been away from the UK? I mean, the stamps are very confusing in most of the cases... You can be away for atotal of 6m...

Well, if Home Office can check that you left when your visa was expired, then you have a problem. They could check by looking at stamps in your passport. Seems you left without having valid leave to enter. This means you broke continuous residence. Look on home office web site, for official rules. ...

About 2 to 3 years ago ; Jamaicans never required Visas to get to the UK - but apparently they 'swamped' the country (According to David Blunkett) - so he had to clamp down on them..

I am sure this had a knock on effect for applications in Kingston as well....
