Re: EEA2 refusal

Thank you so much Sheraz! Do you think it's better to appeal the decision and move some funds to my account (EU national) or proceed with a new application from scratch? What UKBA did, though was considering only the total of my personal account. I don't understand their way to look at things: I and...

EEA2 refusal

Dear all, I would like to have an opinion about my situation. I'm Italian and my wife has been denied the RC on the basis that there's no proof of self-sufficiency of the EU family member from my personal bank account statement that we attached (we applied stating that I'm exercising treaty rights a...

What was your sponsor's European nationality?
I am actually the sponsor. I'm Italian, my wife Japanese. The 6 months are already expired. I called them up only to hear that we have to wait...

I just read through Annex A of Chapter 4 of the ECIs but I totally fail to see the point of such an exercise. Why would an EEA national who only intents to be in the UK temporarily even want to deal with the UKBA and why would the UKBA want to issue a RC in case CSI covers only a short period of ti...

Thanks Jambo. Actually in Italy it`s compulsory to have one because you need it every time your GP directs you to a specialist physician. On top of that it`s needed to buy discounted medicines at any pharmacy. Obviously it`s the same document that Italians use abroad (inside EU) any time they refer ...

@Jambo: your explanations are very helpful! Thank you so much. The only reason I was reluctant to send my EHIC to the UKBA is because shall an emergency arise, I'd probably prefer to go back to Italy to treat it there. In which case to have the card physically with me is pretty convenient. In any ca...

Thank you so much guys! To answer your questions: @sum1: the reason why my wife wants to apply for a RC asap is because we understood that it should have been done within 6 months from the EEA FP issuance and because she needs to travel frequently abroad by herself for working purposes, so she would...

please help: EEA 2 exercising Treaty rights

Dear people, I am Italian and my Japanese wife got a Family Permit at the end of June. She moved to UK at the end of July to arrange our life there and now I'm ready to join her. I have a doubt, though: we are planning to apply for a residence card through the EEA2 form. The point is that I haven't ...

Thank you very much. I grow more and more convinced that the best option for me is to exercise Treaty rights as a self-sufficient person.
I will seek professional advice on the tax issue and decide accordingly.
You guys have been very helpful, thank you so much!

In principle this is possible: you can live in one country and work in another. It is a popular setup in the Netherlands for example, where someone can move just across the border to Germany or Belgium (to have their foreign partner benefit from directive 2004/38) and commute from there on a daily ...

Treaty rights and working for a foreign firm as consultant

Hi guys. I'm trying to figure out a very important aspect on what exercising Treaty rights in the UK includes. I am Italian and will move soon to London because of my Japanese wife's job. I obviously have no problem to legally reside there but in order to get the RC for my wife I need to prove that ...

By the way, is there anybody who can confirm me if being employed by an Italian company with an Italian contract stipulated in Italy and no reference to where I'll be performing my job can be considered exercising Treaty rights in the UK as long as I live there?
THanks.

Just to clarify on the health insurance. Italian EHIC can be considered as insurance. This is a very helpful confirmation. I talked with a solicitor in London a few weeks ago and she told me that my wife needed a health insurance even though she has an Italian EHIC. I thought it didn't make sense t...

I would go for option 1. Just provide payslips. Why do you think option 2 is easier to prove? It's probably not. Also option 2 requires you to have health insurance (Comprehensive Sickness Insurance). As a side note, I suggest you also get an Italian EHIC (medical card) for both of you before movin...

EEA 2 exercising Treaty rights

Hi. I will be moving to London soon from Italy with my Japanese wife and she's planning to apply for a RC once there. From what I understand she's legally entitled to receive it as long as I demonstrate to exercise Treaty rights in the UK. Our situation is pretty straightforward and I don't see why ...

Thanks a lot! The only thing is that she automatically needs to use the EEA FP I'm afraid because it's a sticker in her passport. Probably it's enough to tell the immigration officer that she's there as a tourist in that specific situation, hoping not to create any unneccessary fuss... When a Japan...

As a Japanese, she doesn't need a visa to visit the UK so she can enter as a visitor (tourist) instead of using the EEA Family Permit. If asked, she can explain that she is only visiting now and will return to Italy and you plan to travel together later on this year (and enter using the EEA Family ...

EEA family permit multiple entry

Hi. I am an Italian citizen currently residing in Italy. I just got a EEA fp for my Japanese wife as we intend to move to the UK relatively soon. I would like to have a clarification: as I'm busy with my job in Italy at the moment, my wife is meant to travel to the UK a few times before our final mo...
