Re: EEA (FM) refused because passport not supplied

Thanks for the info and reassurance Noajthan, this really helps. 1) From the documents you supply, it looks like I'd normally have to supply my original passport, but I'd really appreciate it if you could find out whether them accepting my original passport for the various Family Permit applications...

EEA (FM) refused because passport not supplied

I am a British citizen and have applied for EEA (FM) residency cards for my non-EU wife and stepson under the Surinder Singh route. Obviously I sent their passports, but didn't supply mine because I needed it routinely to travel for my work. They have EEA Family Permits in their passports, but these...

Re: Calling the HO

I emailed the following the week before last: BRCDelivery@homeoffice.gsi.gov.uk asking whether they were aware of our change of address, and also about our missing CoA, and they were able to confirm the change of address as well as get a CoA sent out, which arrived just over a week after my initial ...

Re: Help with Surinder Singh Route

Best of luck. I know what a minefield it can be with UK immigration rules. The year 2012 was an unfolding nightmare for me and my family when their visitor visas, until someone on this forum suggested the Surinder Singh route. These assurances from the university sound really strong, so print out th...

Re: Help with Surinder Singh Route

It's true that a Tier 4 student visa should be straightforward and probably no more expensive (when everything is taken into account) than a Family Permit. However, assuming you get confirmation in writing from the relevant people in the university / funding body that a Family Permit is sufficient, ...

Re: Brexit better for non-EU migrants

Given that the current government aims to reduce net migration to the UK to under 100,000 per year, and given that net non-EU migration to the UK was 190,000 per year last year, I very much doubt that the government's stance towards non-EU migration would soften. Furthermore, the current government'...

If there isn't a phone number, is there an email address? I haven't received a CoA for my Jan 2016 application yet. I'm also looking to confirm they know my correct address, which has changed since the application.

Re: Help with Surinder Singh Route

It sounds to me that your funding status drives everything. Get straight with the university / funding body whether your visa type affects your bursary, or is it based purely upon your citizenship. And if it is based on visa, get them to give you clear guidance on what visas make you eligible and wh...

Re: EEA2 / FM-EFM Discussion thread

I sent off my application for EEA(FM) residency card (to Home Office, PO Box 590, Durham) on 30th December 2015, but today (13th January 2016) I still haven't received any feedback. No letter, no phone call, no fees taken from bank account. Then it just struck me today that my bank card failed soon ...

Application received: 31/12/2015

As for today (13/01/2016), no payment taken from bank account, no letter of confirmation received, no biometrics appointment letter. Should I be worried?

Re: EEA2 application for pre-2004 EEA FP

(note that the title of this topic should have been "EEA2 application for pre-2014 EEA FP" - not 2004!) Actually on closer inspection of the guidance notes and the EEA(FM) application forms (both 137-page April 2015 form and the 91-page July 2015 form), it really is ambiguous about whether...

EEA2 application for pre-2014 EEA FP

I am a British citizen and my spouse and stepson have qualified for EEA Family Permits under Surinder Singh since we have lived together elsewhere in the EU. We first qualified at the end of 2013 having lived in the Netherlands, before the Home Office introduced the "centre of life" test, ...

Re: PLEASE someone help us - critical situation!

What were the reasons they gave for refusing the visitor visa? Maybe I can suggest how to address their objections if I know what that are, and then you could apply a third time. Have you considered moving to another EEA country, e.g. Spain? I know the upheaval would be traumatic at this very diffic...

Re: Surinder Singh under a Conservative government

I see PrestonLancs point about the ECJ judgement being about free movement, and so shouldn't be affected by UK concessions with the ECHR. In Directive 2004/38 in the paragraphs relating to family members, it does mention "family life and human dignity", but maybe this still doesn't relate ...

Re: PLEASE someone help us - critical situation!

As far as I understand (I'm not an expert), I think you are right - for an EEA family permit the family member must be dependent on the EEA citizen. So unless you can show that she is, say, financially dependent on you, the only way for her to come into the UK would be on another type of visa. Have ...

Re: Surinder Singh under a Conservative government

Looks like I was getting confused between the ECHR and the ECJ. The govt want to opt out of aspects of the ECHR, but Surinder Singh is an ECJ ruling (presumably following an ECHR principle of right to a family life?). Not sure how that affects anything. Out of my depth here.

Re: Surinder Singh under a Conservative government

@PrestonLancs: Surely the Surinder Singh ruling relates to right to a family life, otherwise surely it would be irrelevant to home nationals because they of course have the right to work in their own country. I think the govt would very much want to force its own nationals to follow the same immigra...

Re: Please answer -SS Family Permit and Income

Presumably you have been working in an EEA country whilst living with your wife there for a number of months, and your question is asking about whether the level of income earnt in that country qualifies for you to count as having moved your "centre of life" to that country? (if you are re...

Surinder Singh under a Conservative government

This is an open ended question, but one I feel needs to be asked (apologies if this has already been covered in another question). Given that the Conservatives won the 2015 general election pledging to leave the ECHR unless they could secure concessions, including restricting the right to a family l...

questions about EEA(FM) for Surinder Singh cases

Hello everyone, I am a British citizen who has used the Surinder Singh route to get my non-EEA wife and stepson into the UK under an EEA Family Permit. Now in the UK, we are looking to get residency cards. I understand that I am supposed to fill out the 137-page EEA(FM) form to achieve this. I have ...

Must they issue the cards immediately without delay? Or are they allowed to be putting conditions on our status a...

Re: Germany: Late residence card for EEA family member

Thanks for the advice. That's an interesting point about when the six months actually starts. I understand what you say about the East, and have seen it in terms of my ex-boss and my stepson's school, as well as officialdom. What I find incredible is the total lack of compassion for our very unfortu...
