Re: EEA worker status for casual workers?

This is a very hot topic at the moment...

A good starting point would be to look for info on XpertHR website

Re: Retained Worker status in the course of employment tribu

The Judge in the First-Tier Tribunal (Social security chamber) has found that I retained status as a worker since I had tried to claim JSA. But I also know that Ukba is not bound by a decision made by a first-tier Tribunal in a Social security chamber..! Is it a good idea to include the Judge's Deci...

Re: Retained Worker status in the course of employment tribu

Thank you. Yes, I did register as unemployed after my maternity leave, but instead of JSA the staff at the Jobcentre Plus have asked me to complete a form for Income support instead (wrong advice), which eventually was refused (of course). So, I had to re-register for JSA after 7 months. So this is ...

Re: Retained Worker status in the course of employment tribu

I can confirm that I am an EEA national, and the reason I am asking this question is as follows: I am considering to apply for PR documentation and I need to know how to correctly account for this period of time, as there is a gap between the end of my maternity leave and the date I signed on as a J...

Re: Retained Worker status in the course of employment tribu

Any suggestions, anyone?
have you come across a similar case before?
Can you point me in the right direction, where to find more info on this topic?

Many thanks.

Retained Worker status in the course of employment tribunal?

Hi there I would appreciate some advice and guidance. My question is: Can one retain Worker status during a period of time while awaiting the outcome of an employment tribunal case (a case of unfair dismissal on grounds of maternity) and following a period of maternity leave? what is the maximum len...

Thank you, Jumbo. It is now allowed to include time spent in the UK under the ECAA when requesting PR - following the ECJ ruling in Ziolkowski et al., also in the case of Carussi. This is my case, as I have requested to include time spent in the UK under the ECAA agreement; I am free to choose any 5...

It is UKBA's normal practice - especially when it comes to EEA applications - to request for additional evidence if necessary, and they have done so in the past. I have the required evidence ready, it was just a matter of requesting for additional evidence. I have not been given the opportunity to p...

From the letter they provided me with, it sounds like they encourage me to submit a new application - for which I now have to pay £55 as from the 1st July - or appeal the caseworker's decision which costs around £140 just to submit an appeal....!! Can I write to them to reconsider the case and inclu...

In the past, they did ask for more info, they could have done the same here.

But what about the exercise of Treaty Rights from Dec 2010 to date? This means I have to provide evidence beyond the 5 years period?!

Well, this is exactly what they wanted to see - 'evidence of how you have exercised Treaty Rights from December 2010 to date' So, yes, they did actually wanted to see evidence BEYOND the 5 years period required for this type of application. This being one of the reasons for the refusal. Regarding re...

I did not provide any documents to cover for 2011 and 2012. If they would have asked me to provide additional evidence, I would have done so. My understanding is that I have to submit 5 years 'lawful' residence not longer than that. I have been unemployed since Dec 2010. During 2011 I have claimed J...

I cited in my letter the ECJ ruling in the case of Ziolkowski C-424/10 and I even include a copy of the ECJ ruling which came out in Dec 2011. I made it ve...

EEA3 application made in light of ECJ case of Ziolkowski

My EEA3 application for PR has been refused. Just to give an overview/background a bit more in details about my case: In light of recent ruling in cases of Ziolkowski and Szeja (C424/10 and C425/10) and following recent amendments to the UK EEA regulations 2006, I have submitted an EEA3 application ...

EEA3 and comprehensive sickness insurance

Hi there I intend to submit my EEA3 application and have a question regarding CSI. From 2003 to 2005 I was a postgraduate student but did not have CSI at that time as it was not a requirement. My official status was self-employed and along with that I was also studying towards my MA degree; I was no...

'Worker' status - A2 national

Dear All, I would appreciate your thoughts/comments on the following topic/question(s): 1. Does an A2 National who has been employed in the UK for at least 12 months ending on or after 1st January 2007, even if this employment was "illegal" by the previously applied UK rules, still qualifi...

A2 national claiming PR

Hi there This is a follow-up question to Obie's earlier post regarding someone who had worked illegaly in the UK before the accession date. Based on C/424/10 Ziolkowski et al v Berlin_Applying for PR

I am an A2 national, resident in the UK since 1997. My question is: Based on the ECJ ruling in the case of Ziolkowski et al vs Berlin C/424/10 and Sieja C425/10, can one apply for PR card retrospectively for the time spent in UK under the EC Association Agreements (2003-2007) plus additional time (2...
