Hi John Does this apply to s3(1) applications only? I see no point in holding s1(3) apps, especially when children are under 2 (as in my case)? Many thanks, h Just to clarify that was for my children. I suppose children don't have to attend "Citizenship Ceremony". Whoops! Yes you are right...

Judgment applies to ILR as well

In HSMP Forum Ltd, R (on the application of) v Secretary of State for the Home Department [2008] EWHC 664 (Admin), in particular paragraphs 52 and 54-57 (reproduced below) the High Court held: 52. In my judgment the correct answer to the "dispositive" question requires a contextual analysi...

Hi John,

Many thanks for reply!

Yes, I was inaccurate in specifying why I have to - I have to travel on company business and will need visa pages, and would prefer to carry one passport instead of two - and my employer is paying the related expenses, so I thought I must do this now...

Kind regards,

Transfer of Conditions (Form TOC) question

Hello Everyone, And Happy New Year! My current passport is full and I have to submit form TOC to transfer my residence permit to my new passport - do I need to send the old (current) one in addition to the new one with the appl. form? Can I send a certified (by solicitor) copy instead? Thank you ver...

I hope Gherson will win the review - it is a stupid policy which affects the very people the government wants to come here. People who do not work/pay taxes won't be affected anyway. Very stupid.

Hi Roger These are indeed valid issues but they are all solvable - you can use services of the many corporate services providers for registered office/company secretary/etc. I used Jordans (www.jordans.co.uk) as they are an established and reputable company, although a bit pricey. for a one man cons...

I think this should be fine as long as you are resident in UK and pay full UK resident taxes (ie. do not take advantage of possible tax reduction schemes/etc)

Roger, I had my own one man consulting company when I moved to the UK. It's fine as long as it is indeed a bona fide business and is not a paper company- that is you will need to have clients, expenses, pay taxes etc. However be prepared to either do all the paperwork yourself - which takes time - o...

Fadibatti This is all speculation at the moment - we are just guessing how things may go. We won't know until an official statement is made, and when it is made it will surely be on the website. It is also unknown when it would be made, because the "5 year plan" has no deadlines/specific d...

Shouldn't be a problem as long as you are not receiving public funds. Also, I don't think there is such a thing as a "paying guest" - you are either paying or you are a guest :-)

All, Thanks for the opinions. So hopefully those with the 3-year extensions (like me) can expect to be able to apply for ILR at the end of these 3 years. Here is another question for us to speculate on: the 5-year plan is expected to move some of the requirements from the citizenship application to ...

Policy statement on the 5-year immigration plan?

Dear Moderators, What are your opinions on when we should expect a policy decision regarding whether HSMP/work permit holders who have arrived in UK before the 5-years residence rule is introduced will be able to obtain ILR after 4 years of residence? Would you expect this to happen? My guess would ...

Whether you have the passport or not doesn't matter. Passport is just a proof of citizenship - it is not citizenship itself. If you lose your passport you do not lose your citizenship. Your son will be Indian citizen regardless of whether he has an Indian passport or not. However, as a matter of fac...

Indeed. One does need *appropriate* experience and qualifications, not speaking about good English. I don't think that will affect your status in the UK - you may be questioned etc but as long as you are not the actual person on the NFL you would be let go - perhaps after some document checking etc.
