MN1 Form Born in the UK but with LTR

I understand you can apply for your UK born son if he is non traveling. In your case he has been out of country so he will need to apply for ILR with you first. I am in simillar situation, please some one let us know if I am wrong. Thank you for help.

Maintenance requirement

I will re apply using set o for my wife and do not have to do point assessment. One thing I am not sure about is maintenance requirements. Thank you so much for your reply. Regarding set m quote, my wife was given leave as my spouse before I became settled though.

Using set o, which category we need to select in section three? And do we need to do point assessment again ?

There is nowhere in set(m) guidance that spouse of person settled through tier 1 can not apply using it. We used checking service too ensure set(m) was right form.

It is valid upto 2014, received refusal on Wednesday. Should we apply again using set(o) or we need to apply flr m and then set(m )?

Thank you for link. Another question, her tier 1 dependent visa is valid till 2014, does she need to apply for ILR within 28 days of my ILR or she can apply in 2014?

ILR - spouse of settled person

Hi, I was on HSMP/ Tier 1 and now settled. My wife joined me as dependent in 2008 and been living with me. However she was out of country for 9 months (Parent ill health/ death) in last 2 years. Will this effect her ILR application?
