Sorry to be stubborn, but if they fall under C(i), why my spouse needs to be under C(ii)? Both of them applied for family routes before 9 july, and both were granted after 9 july. Both have since applied for one extension.

Re: Is SET(M) the right form to use?

Yes, they must have chosen point (ii), as the FLRM was granted under Appendix FM. But I do not think it is appropriate, as this would mean even one applied for spouse visa (not pbs dep)before 9 july and granted after 9 july, she will need 5 years to get ilr if she needs to extend FLRM before getting...

Re: Is SET(M) the right form to use?

She was given 2.5 years leave under FLR(M), and the letter said the decision was made under Appendix FM. So if they made that call right at that time, it would be 5 years I guess. Now, I am thinking of writing to them and complain that they had applied the incorrect rule for that application, based ...

Re: Is SET(M) the right form to use?

Hi Amber, Thanks for your reply and this becomes really worrying now if she needs to wait for 5 years for ILR. I fully appreciate what you’ve quoted in the Immigration Directorate Instructions, but what is your opinion on my logic below? Does it stand any ground at all? The key question is whether a...

Re: Is SET(M) the right form to use?

My wife's PBS Dependant was granted after 9 July 2012, but the application was made on 3 July 2012, before the rule change. Am I right that Rule A280(c) should be valid for our case, and thus we can rely on Rule 287(a)(i)(d) for the ILR application? I was quite sure SET(M) is the right form until I ...

Is SET(M) the right form to use?

My wife needs to apply for ILR shortly, but we are now very puzzled on which form should we use for the application. She initially came to the country as a Tier 1 General dependant in 2012, and extended her visa using FLR(M) the same year after I got my ILR as Tier 1 General migrant. She has now spe...

ILR based on combination of Unmarried and Married stay

Hi Gurus, Please kindly help on my situation: I was in the UK since 2007 on Work Permit and later Tier 1 General. My other half came to UK in Oct 2010 as student, and held Tier 4 Visa. We lived together since then. We got married in May 2012, and my wife switched to Tier 1 General Dependant in July ...

Just got a phone call from UKBA, ILR is granted. They will post back all documents. Good luck to the rest of you.
It's annoying as I would now miss my wife's appointment for tomorrow.

My wife has just received her Tier 1 dependant visa (showing as valid from 12 July 2012 to Feb 2013, applicaition submitted on 3 July 2012). I will apply for ILR in August. Got a few more questions? 1. Can I apply with her as my dependant using SET(O) form? or is that dependant only for those qualif...

The one thing that you must address, without further ado, is to have your wife travel to China and apply for entry clearance as a PBS dependant before 09-Jul-12. Any queries regarding FLR(M) or possible settlement application can be sorted out here in the interim. Thanks very much for your help. Th...

She entered UK as Tier 4 student in 2010. We lived together since then, and have joint account and other individual bank account with same address (although no council tax or utility bills as stayed with friend). Only get married in May 2012 though. My question is whether her Tier 1 dependant visa w...

You don't have to prove anything of the sort - such requirements are not endorsed on the passport / visa vignette. Just keep the evidence of application (fees receipt) in safe custody, should you have a problem in future. Thanks so much for your help, and really appreciate your dedication to answer...

1. Possible. 2. Two. Thanks for the prompt reply, and it seems everyone in similar situation should apply asap before 09/07. Much appreciated. Just one more question on the details: I know the current rule would apply if the application is lodged before 9 July (regardless of when visa is granted), ...

Visa for my wife

Hi, Please can someone help to answer my question below? Thanks a million. I am currently on Tier 1 (general), and my wife on Tier 4 (student visa). I will apply for ILR in August. The new rule means my wife will need to spend 5 years before getting her ILR, if she covert to Spouse visa after my ILR...
