She needs to provide evidence of her ties to her home country (financial, employment, social, property etc). Without it, her visa will likely be refused. When did he APPLY for his visa and what was the visa ISSUE/START date? Spouse visas after 9 July 2012 are a 5 year route to ILR, not 2 years. What I mean is that there would have been no issues if you were working and claiming working tax credit with your husband's name on it.
