Re: Another query on Job Creation - SIGH!

Thank you. From the guidance, pre-April 2014 is still limited to the additional three examples - one job of 24 months, 18+6 months or 4 jobs of 6 months. Or do they continue to be flexible with other combinations - 13 months on one job and 11 on another ? Sorry I did not see previous answers. A foll...

Re: Another query on Job Creation - SIGH!

Zimba's reply does raise a question. If you have to look at it as weeks, then does it mean 52 weeks ? The requirement for a single job to go 12 months does bring some challenges - especially when you are in a start up when the requirements can change over time. I am assuming they made this interpret...

Re: Airport Immigration Problem

Congratulations and I am it was a great relief. Bit unfortunate you had to go through the stress. I have been on T1E for 5 years (ILR process soon) and have frequently traveled in and out of the country. Normally it is a straightforward - what do you do, what does your company do, how many days, etc...

ILR application - continuing employee Vs. New employee

Hi, The guidance states that, to get points for employment, either the two employment previously reported should have continued for 12 months OR 2 New jobs should have been created for 12 months. How about one job that continued and one that is new. Logically that should still meet the objective of ...

Re: Extension application and investment rules

As pointed out, investment for this purposes is money spent for the business. Before the business can pay salaries, it has to have got that money from somewhere. So, in your example, before paying out 22800 on salaries, you have to "invest" that amount into the company. And of course, you ...

Re: Employment requirement for ILR

Some further research landed up with this : Further extensions and ILR applications If the applicant‘s last grant of leave before the current grant was as a Tier 1 (Entrepreneur) (for instance, they are applying for a second extension):  they do not need to demonstrate that they have created two mo...

Employment requirement for ILR

I have my extension for Tier 1. During the past three years, I have provided over 60 man months of employment, so the 2 full time employment was easy. Going forward, the business is not doing as well, so I have been cutting down the employees. At this time, I am not sure if I can meet the 2 Full tim...

Re: Employment after extension of tier 1 entrepreneur

The Tier 1 settlement guidance states : The applicant has: (a) established a new UK business or businesses that has or have created the equivalent of at least 2 new full time jobs for persons settled in the UK, or (b) taken over or invested in an existing UK business or businesses and his services o...

Re: Tier 1 Entrepreneur Investment Requirements

To prove the investment, you will have to submit accounts which show specifically your name and the investment amount. As I interpret, it has to be a business you have started or joined. The definition of "joined" seems to be unclear but I would assume being a Director would be one way of ...

Re: COMPILATION REPORT/MANAGEMENT ACCOUNTS

You need a certified accountant to do this. And any certified accountant would know what it means.
It is a standard report including Profit & Loss, Balance sheet and the accounting notes.
Compilation report also indicates that it is not an audited report.

The guidance specifically say it has to be cash investment into the company. The accounts (certified by the Accountant) reflect the investment. Here's the relevant section from the guidance document Audited or unaudited accounts must be prepared and signed off in accordance with statutory requiremen...

Re: Urgent - Dependant Leave different from Main applicant

Yes, mine is 3 years 4 months and my spouse is 3 months.

But I only moved over 2 months after grant. So, applying for a renewal now is risky if it comes through in less than 2 years.

Urgent - Dependant Leave different from Main applicant

I have a situation where I would appreciate some help. I have a Tier 1 Entrepreneur Visa valid for another four months. I just realised that my the dependant visa for my spouse (applied and issued at the same time as me) expires in a few weeks. When it was originally granted, the difference was expl...

Petition

I was not the author of the Petition and I guess it should have specified both Leave to remain and Visa. The passport is held in both cases. If UKBA is influenced to change on, I am sure they would be convinced to change the other.
Either way, I believe it needs all the support it can get.

TOC - any diff. if Biometrics have been collected earlier ?

The TOC application has a question about whether biometrics were collected before and if so, details of the location and date. Does that mean that biometrics will not need to be collected again i.e. that it will speed up the application processing ? Anyone here who has applied for a TOC with biometr...

Proof of funds remitted

The guidance seems to be a little vague on the proof of funds. The question I have is whether funds deposited into a company (of which I am a director but not a shareholder) qualify to contribute to the 200K sum. The evidence required seems to be only auditor verification of funds having come into t...

Tier 1 Entrepreneur - what is "Own business"

What is the definition of "own business". If I am director of a company but have not invested in it, for example, would that be considered own business ? Alternatively, if I have invested, say 25K, for a 10% stake in the business but have no board or active management role in the same, wou...
