6-month validity rule on passport?

I'm a South African citizen with ILR, living in the UK, and my South African passport expires in August. I have applied for a new passport due to arrive middle Feb, but have been asked by my employer to attend a conference in South Africa early in March. There is a very good chance (given the state ...

Re: Section 322(5) and Naturalisation

Thanks. The rest of the application looks straightforward and we will declare this penalty for the sake of showing honesty (even though I don't think it falls under any of the types of civil penalties they ask for), and then just bite the bullet and pay that incredible application fee. Thanks again ...

Re: Section 322(5) and Naturalisation

Thank you - that's really good to know, and I had not fully realised the legal difference between immigration and citizenship. The quick response is much appreciated!

Section 322(5) and Naturalisation

The news is currently full of cases where highly skilled migrants have been refused ILR under 322(5) because they made corrections to past tax returns. However, my question is if anyone has had the same type of refusal (purely based on HMRC/tax issues) for naturalisation, not ILR? My wife and I both...

Re: No longer have BRP used for Life In The UK test

Thanks, and you are of course absolutely right. Current news about the HO apparently looking for every small problem to deny applications has me paranoid, that’s all.

Thanks again for the replies.

Re: No longer have BRP used for Life In The UK test

Thank you very much for the prompt reply. Is your advice based on personal (or otherwise known) experience of this very same issue? I don’t mean to be rude or question your advice, but it would put my mind at ease to know that someone else has had the same issue and succeeded in their application wi...

No longer have BRP used for Life In The UK test

When I applied for my ILR in 2015, I used the BRP (tier 2 visa) I had at at the time as proof of identity for the Life In The UK Test. When I got my ILR approved (same-day appointment service), they took back my old BRP. I then got a brand new BRP in the post a few weeks later showing Indefinite Lea...

Re: ESOL in Scotland no longer valid if recognised by Ofqual

Update: There are transitional arrangements in place: If the certificate was issued by Trinity College London before 6 April 2015 (as ours were), it's still valid for visa applications up to 5 November 2015 no matter where it was written. See the very last page of the first document here: https://ww...

ESOL in Scotland no longer valid if recognised by Ofqual?

My wife and I took the Trinity College London ESOL for GESE Grade 5 (B1) Speaking and Listening Entry Level 3 at Edinburgh College in September 2014. I remember checking at the time that it would be valid for ILR, and all was well. We finally booked the appointment at the Glasgow Premium Centre for ...

Re: Life In The UK Test Fully booked 2 months in advance?

I just phoned the help line and they confirmed that they are indeed booked up for all of Scotland for the next two months! 4 Slots became available late in November in Aberdeen (nearly 100 miles from where I live in Edinburgh) after the call, so I could book one of those. There isn't even a test cen...

Life In The UK Test Fully booked 2 months in advance?

I'm trying to book my Life In The UK Test online now, but none of the 6 centres listed have any available slots for the next two months! Is this normal (has anyone else tried booking recently), or is there something wrong with their website? The little grid showing dates and times just remains greye...

Child born just before parents' ILR application

My wife and I are about to apply for ILR (we are South African citizens who will have been in the UK for 5 years on Tier 2 in October). However, our daughter was born in the UK in March last year, and we have not left the UK with her since. She currently only has a South African passport and UK and ...

Child born in UK to Tier 2 parents - new form confusion

Any help will be appreciated on the following: My wife and I are both on Tier 2 (General) visas, valid until mid-2015. Our daughter was born here last year. I want to apply for her Tier 2 dependant visa, so that we can travel to introduce her to her grandparents. When it was still an online form, I ...

Suggestions for cheapest English Language test

My wife and I (both South African and lifelong English speakers) will be applying for ILR in November. We're both on Tier 2 (General), so we have to take it. I'd prefer not to have to attend classes and/or pay a lot to prove something that doesn't need proving, so was wondering if anyone could recom...

Child born in UK: in-country or out-of-country application?

Can anyone share their experience with applying in-country for a child born to non-UK parents on Tier 2? The forms for in-country dependant applications require proof of previous leave to enter/remain, which the child obviously doesn't have, and I'm concerned the application will be rejected. Out-of...

Thanks for your input. I'm planning on going to SA in September, but I'm reluctant to wait until I'm there and apply for a dependant visa from there. I'll apply from in-country, and see what happens. I phoned the UKBA and explained the situation, and they said I should ignore the warning on the onli...

Re: Is Tier 2 extension valid for 2 or 3 years?

Question has been answered, and if your initial visa was granted before 6 April 2011, then the extension is valid for 3 years. Detail in second row of the table under paragraph 182 in the Tier 2 Guidance document: http://www.ukba.homeoffice.gov.uk/sitec ... idance.pdf

Re: Extension valid dates

Found it! Thank you very much.

Just for everyone else: If your initial visa was granted before 6 April 2011, the extension is valid for 3 years. Technically, for 3 years + 14 days from the valid date of your new CoS, but 3 years still.
